I am about to issue a warrant to the Halifax bank to reclaim bank chargers, they have not replied to any correspondence from the court, would it be better to get in touch with the Halifax before I send the form back to the court to issue the warrant to them to try and get the chargers back or just send the warrant

Just phoned the elliot davies bailiffs as advised in a few threads... and here is what they advised for anyone interested.....They are High Court Bailiffs
1st you have a judgement from County Court, fill in a form, called transfer up instruction, include a £64.10 court and admin fee which they will also claim back from Defendant (Bank) , as well as their costs http://www.elliottdavies.com/pages/Form2.htm
They will file this with County Court to transfer it up to High Court, <- the time this takes depends on your county court...!!!! .....then get a warrant of execution, then within 48 hours...they will....
go to bank demand money threaten to take their computer equipment and get the money.......the man I spoke to said he has done quite a few and they have always paid up....
High Court bailiffs have more power than County Court.....:p.
Only £9.10 more than going through MCOL......:j

Dont threaten them just send the hce in . Just a thought did the a+l think of what might be going through your mind or how the charges may have affected you when they charged them ? No! search for high court enforcement officers. If your amount is over 601.00 they will charge you £50 plus vat and have more powers than a county court bailiff and let them collect for you. They collect quicker and donot take a no for an answer. Also a county court bailiff will visit a debtor at one given address but a hce will go anywhere he needs to to recover.The defnedant will be the one paying up as well as the hce costs etc.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE. I'm going to request a warrant against HSBC tonight - can anyone advise which address I should use for it to be served to? Will it be my local branch or the Leeds service quality team address?

I believe you send the bailiffs to your local branch or the branch opened your account at.....though not 100% sure.....Reclaimed thanks to this site: £2596.71

Thanks Zena - I've checked since posting and it seems I put down the local branch address and also another business address. Looks like my local small town branch are going to get a visit!!!!!!0
