    Hi All,
    i entered judgment on 1/5/07, which was sent to the Registry Trust Ltd (Registry of Judgments, Orders & Fines) on 3/5.
    I had a mistake on the address, which i have sorted out with MCOL, & faxed it back on 11/5. They are to pass it on to the Registry Trust for the judgment to be logged.
    Until it's logged with the Registry Trust, i am unable to enforce it.
    Are we notified once it has been registered, so we can enforce it & claim our money back?
    The last thing i want is for it to fall on its face at this stage, only i can't seem to find anything on the forums about what happens after judgment is filed on MCOL.
    On MCOL the status under judgment has issued & that it has been submitted to the defendant, & the next stage is warrant which has start.
    How can i enforce it if i don't know if its logged at the registry?
    Any info that people have after passing this stage would be a great benift for me & others claiming their charges back.

  • I could do with a bit of help please someone.
    I have been using the MCOL to claim back my bank charges from Lloyds tsb. I have got to a point where judgment has been entered for immediate payment on the 2nd May.
    The MCOL site now says I can issue a warrant but there are a couple of things I am unclear about.
    The site asks for the Amount of Warrant and Solicitors Costs and says you must fill in these parts. What do I put in? Is the Amount of Warrant the £2750.00 I am claiming or something else, Getting confused Help would be much appreciated.

    I have followed the advice posted on this forum to the letter over the past few months and it has been of great help . I would like to thank everyone for their useful advice .
    I am now in a position where I can see light at the end of the tunnel !!

    I have claimed against Barclays and they offered me £2600 a week ago . Since then I have won the case by default (No defence offered ) of over £4000 .Can the bank go back to the County court and appeal or are they likely just to pay out / If so how long have they got i.e. do i just wait or should I issue a Warrant etc to speed things up .
    There is a lot of advice re getting it to court and letters to send but i am having trouble finding info on where i stand once i have won my case and how to get my money from the bank .
    Any advice would be greatly apreciated . :rotfl: Chris

    what now? how long will it take to receive my money?
  • Lloyds did not acknowledge my claim thro MCOL so i filed a judgement by default last week. I selected they pay full amount immediately. Had a letter from MCOL saying the judgement had gone but have had nothing from TSB. What happens now.? How long do i wait etc? Everyone else seems to talk about acknowledgement but i've not had that. Is this unusual.
    Please help, any advice would be v helpful. thanks

    Hi i am in the same boat as you!

    Lloyds didnt acknowledge my claim my 8th May I requested judgement on the 9th May. However I did all my court claim direct with the court and as they have a 10 day backlog the judgement still hasnt been issued. Im getting a bit worried as maybe the banks acknowledgement/defence is also caught up in the backlog!
    I have read on here somewhere that when you receive the judgement order you fax it and send a copy to the bank (and their solicitors if you have had any correspondence from them)
    Hopefully someone else will see your post and have a more detailed answer.

    I have claimed on a closed LLoydsTSB platinum credit card, and won by default as claim was not defended.

    They are now saying that they will credit my closed account with the monies within 40 days (I presume they mean on day 40). Only after that date can the monies then be paid to me by cheque or credited to my bank account which will take a further few days.

    Seems to be very serious delay tactics as well as a bit odd - any advice folks?

    my friend works in a solicitors and once you have judgement they have to whistle to your tune - they can not dictate 40days to pay you - i would ring them and tell then that if they do not pay by x amount of days you are sending in the enforcements.

    When you have judgement you can request and dictate times etc

    they are taking advantage of the fact they know most of us (me included) dont really know the crack etc on judgements therefore tryin to advise US what to they are going to do when it should be the other way around.

    my friend said you tell them when you want paid - if they dont send in enforcements.

    I recieved the same judgement on 25th April, but still no money from Lloyds.

    I paid for a warrant to be issued on Monday, so will have to see what happens now. That cost £55.

    supposed to give them a week to settle - however they wont (not being negative but thats lloyds for you) i would ring them or fax them a letter stating you have judgment (fax a copy of it when you fax letter over) saying that you want the money in your bank by XXXXX and if its not then you will enforce the judgment (i.e. call bailiffs)

    you'll prob have fight onyour hands however remember YOU are now in control - they have to pay you back the money although they'll tell you things like "40 days time" etc - my friend who works in a solicitors said give me a deadline of a week if nothing call in enforcement - you owe them nothing so dont give them extra days

    they take advanctage of the fact we dont know the legal jargon and hope thay by them dictating to us we think we have to but when you have judgment that isnt the case - they have to whistle to our tune and if they dont then bailiffs it is!!

    all my info on what to do is from my friend who works ina solicitors office and has done for 15 years and deals with courts every day so its 100%
