Hi All, I have been claiming back £4000 of charges for my partner from RBS. They did not file a defence so got a judgement by default. A letter landed on our doorstep yesterday offering just under £3000. I gave them a call advising them that they had not defended the claim and that a warrant had been issued to the court bailiff, her reply was that is our final offer! im baffled i think im right in saying that the bailiff will now recover the full amount requested? Any help on clarifying this would be great0

hi i hope some one can help i have gone through all the stages of mcol and i have got up to the warrent stage it says the warrent has been accepted, The warrant has now been sent to the bailiff at the appropriate court for action. what i wanted to now is do the baliffs get the money back for me or do i have to send the warrent to nationwide myself please can someone help.0

I HAVE TRIED TO CLAIM MY BANK CHARGES BACK FROM LLOYDS TSB PLC,
I SENT THEM MY 1ST LETTER ON 26/3/07 HEARD NOTHING SECOND ON THE9/4/07 THIS TIME I GOT A STANDARD WEARE LOOKING INTO IT.I SUBMITTED A CLAIM TO THE COURT ON THE 24/4/07.THEY DID NOT PUT IN A DEFENCE ,SO ON THE15/5/07 I ASKED FOR A JUDGEMENT WHICH WAS SUCCESSFUL.I HAVE BEEN TRYING IN THAT TIME TO TALK TO SOMEONE AT LLOYDS TSB BUT THE HELP LINE WAS ALWAYS BUSY SO THEY ASKED YOU TO LEAVE A MESSAGE BUT THE VOICE MAIL BOX WAS ALWAYS FULL.SO I CALLED JUST TO THE NORMAL CALLCENTRE AND WAS KEPT ON THE PHONE HOLDING ON AND OFF FOR 1 HR 6 MINS TO BE TOLD THAT THEYHAD STOPED ANSWERING THE HELP LINE AS IT WAS TO BUSYSO I REQUESTED A WARRENT WHICH WAS ISSUED ON THE 22/5/07. BUT STILL I HEAR NOTHING.SO I CONTACTED THERE SOLICITORS DIRECT AND WAS IN FORMED THAT THEY HAD CANCELLED THE BALIFFS AND WAS TAKING ME TO COURT TO OVER THROW THE JUDGEMENT CAN THEY DO THAT AS IT WAS THEM IN THE FIRST PLACE DID NOT PUT IN A DEFENCE.SORRY TO BORE YOU ALL AND EXCUSE MY SPELLING BUT CAN ANYONE HELP ME PLEASE XXXXXJULIA

Just a quick note regarding the courts holding on to payments. Once we receive a payment into court they are processed but are not released for 14 days to ensure that the cheques have cleared. If anyone has any warrant related queries ill do my best to answer xPay Debt by Xmas 16 - 0/12000

Anyone have any idea how long it takes to recover the money when you send in the bailiffs? It's beginning to look like i'll have to go that way with the bank0

Having gone through the whole procedure from the beginning of Feb, I am now at the point where I have won my case through the courts by default. I then politely gave them 2 weeks to pay, no luck there so I executed the warrant which was sent to my local county court on 20/06/07.
Does anyone know the timescales from here? or how do I chase my warrant with the bailiffs as I would like to know if they plan to visit my local Halifax branch so that i can be there!!Keep right on!!0 -
