    Apologies if this has a sep thread somewhere, I've looked and can't find one.

    We have a claim in progress against Barclays through money claim online. Barclays did acknowledge the claim within the 14 days, but have not submitted a defence within the 28 day timescale.

    I have now asked for a judgement by default online and requested immediate payment.

    My question is; How soon should I chase the Bank for our money? or, am i being a little optimistic at this stage?

    I started a claim for Money Claim online at the beginning of March this year.
    The bank acknowledge the claim but didn't file a defense with MCOL.

    By the beginning of July, as I'd heard nothing from the bank or the court, I emailed and phones MCOL and they advised me to apply for a judgment by default.
    I did so and the judgment was issued on 3/07/07
    I have heard nothing from the bank so far.

    I've been trying to look on the MCOL website and on this website but can't find the info I need, so here are my questions:

    What should I do next?
    Do I write to the bank and demand my money?
    Can the bank still get the judgment cancelled?
    How long after a judgment has been entered can a warrant of execution be issued?

    I've just posted a thread with similar questions - no replies as yet I think but check it out as well just in case...

    Edited to add: the judgment by default was issued on 3/07/07. When I checked online a couple of days ago, their was an extra box on the page to request a warrant of execution, so that made me think the bank had approx 14 days, but really not sure!

    What bank are you claiming against? I'm considering phoning Barclays and asking for my money.

    I'm claiming against Shabbey - I mean Abbey lol.
    They're trying to waste my time I think as my account with them is closed and has been for a while. They can't even get my name right so...

    I was thinking about writing to them but not really sure what to do!

    Hi,
    Although in the court process (entered judgement by default) im new to all this and if it wasnt for the supportive people on here i would not have gone this far,reading all the successes and moral support given to others spured me on but im now in need of some advice should i ring the bank and ask about the money before i execute the warrant ? has anyone got this far and got them to pay up after a phone call, rather do it that way than wait for ballifs to get the money back. bank is halifax by the way.
  • I have won in the County Court against Lloyds TSB and have judgement against them. However I have not received payment. Does the OFT action mean I have to wait??? Or as I have a judgement in my favour do they have to pay up??

    As you have a judgment in your favour apply for a warrant of execution the cheque will turn up within days of the baliffs visit.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • I need help, I took my bank to court on the 5th July, given them 2 weeks to defend it.

    Great! I thought - They did not defend it, so I have won by default. I filed for judgement on 20th July, which I received the judgement for claimant on 24th stating that I should be paid in full forthwith.

    With what has currently happened with the OFT taking the banks to court, and peoples cases being suspended, where do I stand, do I still receive the money that they owe me, or is my case suspended too?

    Martin I really need your help now, with knowing what will happen next to my case?
