    Thanks Ben, as I said I dont believe he was a TRO no, but 'as close as' When I googled TRO York nothing came up so I just rang the council and explained and thats who I got put through to...

    It seems as though they are going to come in whether I like it or not today, SO I have written a letter for them to give them.

    It basically says I am revoking permission for anymore viewings and will treat any further communication from 3 named agents as harassment and they will not be responded to (EA in charge of selling, director and some nasty woman on the phone)

    I have stated in the letter if any other agents wish to discuss a viewing with me it will be with my express permission only, and if it descends into emails like yesterday then I will ignore the correspondance. But I will not speak to those involved yesterday.

    I know there are FAR too many 'give ups' in that letter, but at least if they have it in writing my position is stronger?

    I would not do that letter.

    Copy what ben wrote and what you were given at the beginning, put that in an envelope and tape it to the door.

    Will try and post something in the next 15 minutes.

    In the mean-time, try to locate your local councillor - list will be on the COuncil web-site. Ask to meet with them urgently as their housing department are not providing a service which ensures tenants are safe from bullying EAs.

  • Didnt see your last post Marlie, so your council guy backed them off. Thats good news, emergency over but you will still have to face it again in the future. Having said that you have some pretty useful emails there as evidence in a case.

    When this afternoon's nonsense is over let me know the outcome and I'll write the letter for you, chapter and verse on what the various breaches are and make your refusal tot allow access stand up legally.

    Marlie we're all sitting here cheering for you. You are perfectly within your rights to not let anyone from the LA in . If your friend is there then yes let them (if you like the look of them) in on the understanding that you are recording the conversation. If they say no-then refuse them entry and say they will need to reschedule the appointment for a time and place you can both have independent witnesses present.

    Second bit.
    Section 6 of the Criminal Law Act 1977 states:-

    Violence for securing entry.E+W
    (1)Subject to the following provisions of this section, any person who, without lawful authority, uses or threatens violence for the purpose of securing entry into any premises for himself or for any other person is guilty of an offence, provided that—
    (a)there is someone present on those premises at the time who is opposed to the entry which the violence is intended to secure; and
    (b)the person using or threatening the violence knows that that is the case.

    He told them what they were proposing to do was illegal, apparently, but then said 'they just want to come and do an inspection, will you let them do that' and honestly I felt pressured into it so hes rang them and told them they can come at 2.

Well I suppose he is the guy acting for you but when the person comes let them know that you are only allowing it because of the threats and intimidation and that they havent heard the last of it. Takes names of everyone there. Full names, not just John. If they wont tell you, make a note of that as well

    I know the full names of all the agents so will ask for any other names. Won't let them in without full names.

  • Interesting that it has changed from a viewing to an inspection. You look more unreasonable denyng access for an inspection than you do for a purchaser viewing. They are getting tactical all of a sudden
  • I dont want to bad mouth your guy but his job is to protect tenants rights not be caught in the middle. True the best solution is always a win win but when someone is threatening to force entry the time for being in the middle is long gone in my book
