Got this back from DVLA this morning.
Thank you for your email of 14 December about the release of information to a private car parking company. I have been asked to respond
We received a request for the keeper details of **** *** on 26th July 2012, at the time the vehicle record held no details, so no information was provided to the company. The record was updated after this enquiry, and when the company made a repeat request on the 7th December the information was released.
Please see the relevant section of the British Parking Association (BPA) Code of Practice (CoP) -
33.3 You must post the parking ticket to the keeper as soon as possible. Your target is to send the parking ticket to the keeper of the vehicle no more than 14 days after receiving the keeper data from the DVLA, and no more than 35 days after the unauthorised parking event. The time limit you have to notify the keeper is no more than 28 days after receiving the keeper data from the DVLA
and no more than six months after the unauthorised parking event.
As you can see, the request would not be in breach of the CoP, but if you wish to complain about any of the actions taken in this particular case you should contact the BPA at Stuart House, 41-43 Perrymount Road, Haywards Heath, RH16 3BN.
As you may be aware, information about registered keepers of vehicles can be released by the DVLA under the provisions of the Road Vehicles (Registration and Licensing) Regulations 2002. This legislation allows information to be disclosed to third parties who can demonstrate that they have a reasonable cause to receive it. In light of the timeliness of the first request, coupled with the lack of information at that time, we do not feel this company was unreasonable in requesting the data for the second occasion.
Please are you sure i can ignore this as i am in no position to pay the charge should it go to the next level?

You stand exactly where you did before. And the DVLA are right in that the PPC appear not to have broken the BPA CoP here because they did actually apply in time.
But that just means you are back to ignoring the whole scam from now on, all the debt collector letters, just file them (perfectly safe and quite fun, I have ignored two fake PCNs myself!).
You can't use POPLA because the incident was before 1st October - so I would NOT appeal at all.

Hi, first time posting on this forum,
Just as others I have been issued a parking charge notice from vcs. I was about to appeal back with the below. But I am going to run this by the councils legal dept (may as well given I work for the council). further more having revisited the site I saw the white van in question, solo driven so I ask how they are managing to drive and operate a camera at the same time.
I'm thinking of ignoring the letters but want to take this matter further. I don't know how they are able to get away with it
First of all I would like to make clear how outraged I was to receive such a non-official demand for payment of fine for so called offences taking place on what would clearly be taken as public highway. Given that the roads are officially marked under highway code (I.e. yellow lines, official speed signs, bus stops, etc).
I have not been to robinhood airport for some time now and before this wasnt an issue. To which I have since revisited the roads in question and had my passenger photograph the roads. Cross checking these on Google maps they clearly haven't always been there.!
On the day of the alleged offence I did not notice the signs, given they were unofficial and somewhat out of my direction of travel, I.e. would have meant not focusing on the road in order to read any of the text. Which, if you check your CCTV footage you will see that when I was Parked up I actually got out of car to read what the terms of conditions of these signs were. At which point I relocated to the airport car park. So how in that time the images were taken I don't know (other than the innocent are being preyed on).!
Secondly if there is a no stopping law on these roads they should be painted with red lines and not yellow.
As a member of the council I am all too aware of such contraventions and know my rights in terms of what I have and haven't breached. As stated above, having read the small print on such signage, which I ask yourselves to legally attempt to read these without stopping the vehicle, this is a scam and a matter that my legal department will be looking into. Any further communications will be taken as harresment and matters taken further if not cancelled.0 -

I also got a letter demanding £60 for stopping for 90 seconds in a layby within the airport in the interest of safety when the mats moved affecting the foot pedals. I appealed to POPLA and guess what? appeal denied in favour of VCS so now they say I owe them £100. So if you can't stop in an emergency to avoid a possible accident what can you do? I have read all the stuiff on the i/net about POPLA being a waste of time in that they favour the parking companies. Any advice on whether to pay this £100 or what can one do to avoid being another victim of these highway robbers?0

The advice would be to start your own thread.
You likely lost at POPLA because you used mitigating circumstances rather than appealing on points of fact/law. Mitigation NEVER works, even POPLA themselves say this.0 -

Not sure how you managed to lose a POPLA appeal v VCS at an Airport but maybe the clue is in the fact you obviously haven't read all the current advice (such as how to 100% win at POPLA, which every poster has done since Easter)?
