  • Hi Everyone,
    My first post is about VCS.

    I picked up my son in law at RHA on Tuesday 13th November at 7pm.

    This is the first time I have ever picked anyone up at Doncaster and whilst trying to work out where to go I had an unknown white van appear really close up behind me. Now although I am a guy of 56 years and not prone to the yips I found this quite unnerving.

    I then drove off and then saw the very small "official looking" signs at the side of the road. These signs are also impossible to see unless a driver stops to read the small print, which I did on a quiet side road, only to find the headlights behind me belonged to the white van, with it once again parked really close behind me. Once again I drove off and it was only at that stage did I put the road signs and the white van together.

    I have absolutely no doubt that this would have probably scared a lady on her own as the driver makes no attempt to explain the situation but could be easily taken as a potential mugger / robber / thief.

    I now believe that I may receive 2 no so called "Fixed Parking Notices", which I now believe have absolutely no legal justification, are speculative invoices and can just be ignored.

    Is this still the situation and what is the legal position.?

    This is still the situation and you can indeed safely ignore the whole scam, as you would ignore any fake PCN from a private firm for whatever made-up 'contravention'.

    ...I still suggest people look at the OLD letter chains thread linked there, as most PPCs have not changed their letters much at all. :)

    I have just received a Parking Charge Notice dated (10-12-12) on the (13-12-12) for a contravention that took place on the Doncaster Airport Approach Roads, wait for it, on the 23-07-12.

    Having read all the posts regarding this issue, I feel that i should do nothing, But I have just read a copy of the British Parking Association,s Code of Practice that i presume VCS has signed up to and agreed to operate in accordance with the Code?

    I found this
    (4) The notice must be given by:
    (a) handing it to the keeper, or leaving it at a current
    address for service for the keeper, within the
    relevant period; or
    (b) sending it by post to a current address for service
    for the keeper so that it is delivered to that
    address within the relevant period.
    (5) The relevant period for the purposes of sub-paragraph
    (4) is the period of 14 days beginning with the day after
    that on which the specified period of parking ended. page 33

    also on page 38 there is a nice flow chart, under the heading Issue event it says You must deliver letter to keeper within 14 days after the issue event occurred.

    Can anyone tell me how long after the contravention date VCS have to issue a parking charge notice? it looks like the local authority or Police have up to 6 months.

    So the date of the incident was July?!

    That means you can't use the POPLA appeals procedure (new for incidents from 1st October) but that's not a problem. I would just ignore the PPC and I would also email the DVLA to ask why they gave out your data in DECEMBER for an incident so old, surely this timeline is against the BPA code of practice and would mean that the DVLA would have had no 'reasonable cause' to release your data.

    Use this email and enclose a copy of the offending rubbish invoice:

    Completely ignore the PPC though, tick of the letters here on the 5th thread down on the current forum 'PPC letter chains':

    Hope you realised this little tiny thread you posted on wasn't the only one on this scam? Every thread you see on that link, underneath the PPC letter chains sticky, is about ignoring and reporting and fighting back about this sort of con.

  • Hi there guys I'am very new to posting on forums so i do apologise now ;)

    Today I just got back from "Robbing" Hood Airport from picking my girlfriend up, I checked the internet and the flight was on time.
    As I approached the airport I just pulled in to one of the roundabouts to have something quick to eat as I'am diabetic and felt low on sugar and also really really excited about seeing my girlfriend again. It was just myself parked at the second roundabout from the Airport around 20;00 HRS.
    So there I was having a quick sandwich and then a van drove right up to me and made me feel a bit on edge how this happened. He drove right up to me stopped and suddenly reversed back.
    As he drove off I notice he add all the speed camera signs on the van and i thought it was the police speed vans
    So I followed the van to ask what was wrong and why did he do this as I thought it was weird!!
    As I got to him I asked why he did this and his answer was " I took Ya picture mate as you was parked on two yellows " I then said what the problem was as I was not parked on the main road so why take a Pic?? he's reply was "because your going to get a fine through the post mate" I replayed back by saying "a fine for what and How much" :mad: and then he replayed "I don't know I just take the pics there`s signs at the side of the road telling ya your not allowed" I replayed " if I pull up to read the signs ill get another fine lol". he then drove off not wanting to to discuss the situation with me.
    So I`ve read all your post on here and comments and just wondered if I should reply or appeal to the letter that comes through the post.

    It's your choice whether to:

    a) Ignore the whole scam, all the debt collector letters, just file them (perfectly safe and quite fun, I have ignored two fake PCNs myself!).

    OR

    b) appeal with the determination to put this to POPLA (see the sticky thread, second to top of this parking forum, about POPLA). If you do appeal then say that you are diabetic, which is a condition protected by the Equality Act 2010 and so they have to make 'reasonable adjustments' for you by law. Say that you had to stop to eat and drink as a consequence of your protected medical condition and to continue to pursue this PCN would breach the Act. Then say the same to POPLA if the fake PCN is not cancelled. And if POPLA don't cancel it (then they'd be idiots) you can revert to a) = ignore it again.

  • I think I will ignore it when it comes through lol. Thanks for your help with this.
    If I knew the procedure was in place I wouldn't have done this!! But we're I parked was just off the road and not interfering with any traffic. I will keep u updated on the situation. As all other posts state there ignoring the letters.
