Hi guys, just after a little advice. I received the notice after I got back off holiday.

Basically I pulled in at a bus stop as my car mat was lodging under the pedals so I did the logical thing and pulled in to sort it out, literally 60 seconds! Apparently that's a finable offence.
I appealed against it and you guessed it, it was declined. I did this before reading up on the subject but the area now seems a bit sketchy because I appealed so I'm unsure where I stand.

My letters and email can be found on my photo bucket rdboulby

Here's the email

To whoever it may concern, I am emailing with regards to a recent letter I have!received!regarding a parking charge notice Ref VC01
I am appealing this parking charge for the very fact I was not parking. The reason I had, and I state HAD to pull in was due to my vehicle mat in my vehicle becoming lodged under the pedals. After nearly having an accident on the previous roundabout I pulled into the nearest safe location to dislodge the car mat.
I know I have not!committed!any breaches of laws here and pulled over in a safe manner to rectify what could have escalated into an accident causing injury and damage to me, my passenger, another vehicle and occupants as well as the upcoming roundabout.

I await your response

Mr tuner ;)

Anyone had dealings after an appeal and then ignoring?

You haven't committed an offence for starters. VCS are a private company and have no power to fine or give you financial penalties.

VCS have also been involved in an important case with the Upper Tier tax tribunal which sets precedents.

    Ignore them from now on.

Total losses suffered by the landowner (assuming it is Doncaster Airport) = zero. Ignore VCS they are easy enough to ignore.
  • Just wanted it clearing up as its seriously unaffordable at the moment.

    I'm sure I removed my details :S

what did the original letter saying that you owe them £X say?

what did the follow up "appeal unsucesful" say?

It doesnt change anything you still owe them nothing, and they wills end you all sorts of threatening letters, from which as legaly you owe nothing, you have two choices:
1: ignore everything and all further correspondance with them, but keep this place updated on how things are going and what you receive from them as it will help other people, and if in the extremly rare case they issue a genuine court claim form ( highly unlikly) you will be able to get advice on here on what to do - also once the letters stop coming post back and let everyone know.

Option 2: fight back, as soon as the threats start fire off a letter to both the airport, and the parking company telling them that you wil not be paying as its an unenforcable contractual penalty http://en.wikipedia.org/wiki/Dunlop_Pneumatic_Tyre_Co_Ltd_v_New_Garage_%26_Motor_Co_Ltd
further more you should also say that you no lomnger wish to receive any further comunications form them on this matter ( other than an apology ) otherwise you will regard it as harrasment, and appropaite action may be taken against VCS and the airport.
The necxt stage is to attmept a harrasment case against the airport, ( and vcs) as the airport are jointly liable for the actions ( ie harrasment) of their agent (VCS)

  • I think I'll ignore from now on, I'd like to post up the pics of the letters but not allowed yet.

I shall keep people updated on what happens

    Have a look here:

    https://forums.moneysavingexpert.com/discussion/2214803

The letters may already be there, in which case no need for you to post.

If they're not, then PM Crabman, he may be interested in receiving a set.

Don't be daft! We have heard of this scammer before and loads of people have ignored them before. It's only VCS which are the laughing stock of the forum right now!

Where do you think those pics in the sticky thread come from? They come from ordinary posters and newbies like you who take the time & trouble to send their pics to Crabman. It may just be that no-one has sent that letter chain to Crabman yet, or you haven't looked at other named PPCs and found your letter chain listed there instead.

Chances are that you will find your debt collector letters shown under another PPC. They all use the same usual supects for their junk mail.
Anyway a couple of VCS letters are there and so are Excel letters (same firm); have another look.

There have been lots of other victims, who have fought them simply by ignoring them.

There have also been two recent landmark court cases involving them, VCS Parking Control vs. Ronald Ibbotson, S!!!!horpe, 2012 and VCS Parking Control vs. HM Revenue & Customs, Upper Tax Tribunal, 2012. In both cases, the judges found that only the car park owner can take drivers to court. The Upper Tax Tribunal is a court of record, equivalent to the High Court, and therefore its judgement sets a legal precedent.
The acquisition of wealth is no longer the driving force in my life. :)
