    Stop worrying, it will never go to court. You are taking this bunch of clowns much too seriously. Please believe the advice that is being given on here, these people know what they are talking about.

    The OP made a good decision. It was on a private road, not on the public highway. Since VCS' run-in with HMRC, only the landowner can take drivers to court.
    The acquisition of wealth is no longer the driving force in my life. :)

    Surely I can use duress as a defence as the reason for pulling in was the lack of movement in my pedals caused by the mat getting stuck. I feel I had to pull in, especially with th upcoming roundabout?

    Anyone know where I can get some solid advice? I don't want to be stuck with large fees I it does go to court?
    Like I said I'm very uninformed on this matter as I am only 21 and never experienced anything like this

    You still worrying about this scam piece of paper?! Calm down, do you get this jumpy when you get phishing emails as well?

    Your chances of a fake PCN from any PPC across the land going to Small Claims is less than one in ten thousand! And even then their chances of winning the case would be almost zero after recent decisions involving YOUR fave PPC, VCS. It's almost certain that VCS would LOSE any case they try right now due to their contract not giving them the rights needed to offer a contract nor pursue a charge in Court.

    But theoretically, if someone did lose a Small Claim then the amount of costs has a very low ceiling (£50 expenses, plus a similar amount if they bring an expert to attend). That's just to put your mind at rest that there is NO CHANCE of you having to pay huge costs, it can't happen in Small Claims.

    You are not liable to pay and you must not 'appeal' either. This is a private company with an unsolicited invoice, dressed up to impersonate a parking ticket.

    Their is no need to worry, youve doen the right thing - you havent lied to them - which could then be used against you if it gets that far ( highly unlikly) reading througha few of these cases the "I wasnt driving" excuse is probably the worst way to go about things.
    its still an unenforcable penalty no matter who was driving.

  • Hi there - am in the same position as you! Didn't see signs in what used to be a free car park but is now 2 hours only, a joint carpark for 5 large retail outlets and no way to pay extra if you want to stay longer. I'm amazed the shops are agreeing to it. I appealed as well and immediately got an email saying I should reply within 7 days giving the name and address of the driver. I haven't done this yet and today is the 7th day. If I do reply I will only say I cannot confirm who was driving. I don't know if this counts for anything as I've read a law is passed which says the RK is liable anyway. It is worrying, even if you read all the messages on here. I don't know anyone who hasn't paid a similar notice as everyone I know who has received one paid up straight away, thinking they were like the council and police penalty notices. My friends are telling me to pay to avoid all the hassle. VCS are asking £60 increasing to £100 which is ridiculous. It's heartening to hear they have lost a case against them. I would be very interested to hear how you get on.

    Welcome to the forum, however to keep threads clear and to the original problem you should have started your own thread.

    Your friends are stupid if they are telling you to pay, I have recieved several ppc invoices - coupon mad has had a few too as have many many more of us on here, that is why we're on here to educate unsuspecting members of the public about this common scam.

    You are no different to the 1000's that have posted before, what you have is merely a speculative invoice requesting you pay for something that is not legally enforcable precident set by VCS v R Ibbotsen where a judge ruled that only the landowner can pursue for costs not its agents.

    Ignore the letter from now on, you wont get taken to court, if by the extremly slim chance they do take you to court it would be thrown out at the mere mention of the above case. If you want some fun put them under notice that you deny the alleged debt and say any more correspondance will be treated as harassment. If they continue to send letters start a MCOL claim and sue them.
