If you dont want it dont take it, give it to charity, I cant understand why you wouldnt want the money, if entitled.
I cannot take any extra money for a partner who is subject to immigration control, if they pay the couples rate then i am taking extra benefit, talking to several people on-line today they all same the same they only get the single rate on the premiums because of tere partner not being allowed any extra funds this is the reason why i am saying it cannot be taken.0 -

and the customer is entitled to DP
guess what,
I will award the couples DP

Due to you being on any rate of care you dont get charged non dependant rates for HB/CTB so in other circumstances if someone came to live in your home you would then receive full 100% Council Tax Benefit in your own right regardless of that persons income and they wouldnt be expected to pay towards this.
I hope this rule applys in your circumstances for your piece of mind.
I would like to think that no recourse to public funds means in his own right and has no bearing on your circumstances but unfortunately i am not fully aware of the minefield of immigration and benefits.

I dont want to argue, but i did call the D.W.P today and they called me back on a 3 hours call back and they told me that is will only be paid at a single rate for both premiums were one person is subject to immigration control. like always i made a note of the date and time and the name of the team leader who called me, so i will quote them if need's be, thanks for your advice any way.0 -

dont apologise i was the one rude not you, i thank you for your help here, is always good to have any set of fresh eyes reading something, i will have to come to this problem if it arrises, fingers crossed it want but i hear what your saying, you know your job better than anyone, i have this mans name who phoned me so fingers crosssed if they cannot do it i will go back to him, hoping he will be able to resolve it, if not back to welfare rights, oh is a lot of hastle at times, it times like this i wish i had good health and could work.0 -
