  • thanks, it's just with a partner being here with no recourse to public funds i carnt take benefits for them, it has to be a single claim, welfare rights said they would do this because if i took the cuples rate my partner has then taken public funds through me, if i have problems i will go back to welfare rights and get them to deal with this for me.
    All i need them the council to do is explain how the housing and council tax benefit is worked our making sure i dont take any extra benefits for partner, if anything is owed from partner being there then i will have to pay, but trying to get this breakdown from them is a nightmare, but thanks for your kind words, but if dont sort this out it will be a short marrige if i break any of the rules she will be going back home before any honey moon strarts

    You will have to phone I.S to tell them she has arrived, they will send you a form an A2, you will get the couple DP, but lose your SDP.
    HB I dont know, but I dont think you will have to pay any extra in the end, as you get full entitlement due to your I.S good luck with the wedding :)

    Why will i get the couples DP, it makes no sense? if i say to them i dont want to claim any extra public funds for partner and they ONLY pay me the single rate I.S, why would they pay a couples one on the other?
    When i went to welfare rights they said it would not be like that, can i ask how you know this? thanks

    I get the enhanced disability premium and the severe one, both of theses your can get as a couple rates, i have a partner who is subject to no recourse to public funds, what i'm saying is i cannot take extar money for him, it has to be the single rate, what i was asking is you same i would get I.S as a sinlge person but they pay the premiums at a couples rate, or the one rate that you said, it makes no sence to pay me like this on I.S as a single person but then pay a couples rate for the premium(s), i'm sure if i tell them they will continue to pay this as a sinlge rate, i dont understand where you get this from this is the only reason why i'm asking as welfare rights did the full check for me and said i would get around £116 a week.

    my partner is coming to live with me and getting married in August, they have No recourse to public funds and No work on a marriage visa from the U.S.A,

    Your partner can't live with you in the UK on a marraige visa, as after they marry you, they must go back home.

    If you come to the UK as a visitor for marriage or civil partnership, you are allowed to remain here for a maximum of 6 months. When you enter the UK, we will stamp the duration of your permission to stay in your passport.

    When your permission to stay expires, we expect you to return home. You cannot 'switch' into a different immigration category.

    In other words, they will have to back to the US after they marry you (and before their marriage visa expires) and then apply for a spouse visa if they want to live in the UK. Did you apply for the correct visa in the first place?
    RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

  • Hi yes we know all of that we have the correct visa, i wont go into to much detail on here but they will be staying on its the correct visa, is just the disability premium i was worried about, it seems the person who told me may be wrong i was looking to see if anyone else has had the same problem at all

    If you are already planning for him to enter the UK on a marriage visa and then become an overstayer, are you aware the immigration rules have changed?

    No free NHS on a marriage visa or as an overstayer, even if you submit under Article 8, as his entry visa rules will apply. No more 6 years (3 x 2) DL to ILR, pleading Article 8 of human rights. It is now 10 years (30months x 4 visas outside UK immigration rules) if he can get it and then is able to and can afford, to keep renewing it. The 14 year illegal in the UK route to ILR has now been changed to 40 years. Even if he enters the UK before the rule changes on 9 July, he will be applying for DL outside the immigration rules and will therefore come under the new rules.

    Do you realise you can still sponsor him legally under the new rules, as you claim DLA? Fiance visa (no working allowed) where you marry within 6 months and then switch in the UK, to a spouse visa (where he is then allowed to work). Both fiance and spouse visas allow free NHS. A much cheaper (medical treatment and visa costs) and quicker route to ILR for him.
