Advice on my HB/CT

Hi All :T
I am new here so trying to get some advice i read one thread about the person who had problems with an immigration and benefits, i am now having problems, i'm on disability benefits I.S and D.L.A for being disabled and my partner is coming to live with me and getting married in August, they have No recourse to public funds and No work on a marriage visa from the U.S.A, i keep being told tell the council you want a single persons rate, and you dont want to take any extra money for partner, easier said than done, as the council say no your a couple and we adjust your benefits and when i say i dont wish to claim any extra benefit for partner they never answer me straight and even when the team leader is asked they dont seem to know what the breakdown is?:( all thet ever say is this ....housing and council tax benefit
If you are a couple and one of you is not
subject to immigration control the person
not subject to immigration control is
eligible to claim both Housing Benefit
and/or Council Tax Benefit for both of you.
In order to do so you must both have a
National Insurance number.
Potential claimants should however
consider whether it would affect their
immigration status
we have problems here as partner does not have a N.I.No but we aim to get the F.L.R very quick after marriage so hope to try and get that sorted very qucik fingers crossed, but it's the no recourse to public funds, they dont just answer us and i dont want to take any extra and stop any futher leave from being granted, can any of you good people kindey offer any advice thank you all :o

    you wouldnt get more housing/council tax benefit for having a partner. As youre on is you already get the full amount
  • Thank you for the reply, my concern is there treating us as a couple, and i cannot claim any further money for the on my HB/CTB and the council cannot give me a break down, if my partner is added to the claim and i lose the sinlge persons allowance what have they replaced this with?? if it was a discount for my partner then this will have an effect on the status for Further Leave to remain, so we dont know how this works and wonder if anyone else has come across the same problem??:(

    how can you add your partner to the claim if they have no rcourse to public funds?
  • You have to inform them of a change and the claim is in my name, but i now have a partner and they have to add them by law, the claim is not in there name but anyone who comes to live with you are added to your claim, they have removed the single person discount that applied to me, but when i ask them what have you replaced it with they cannot tell me, all i get is its done by the computer they understand what i'm telling them about partner having no recourse to public funds then they say to me they have to tell me it could have an effect on my partner F.L.R, this is the worry

    Do you have Incapacity beneift on your Income Support claim, or are you a lone parent with DLA that gives you the disability premium

    I'm a sinlge person on I.S switiching to the new E.S.A soon getting D.L.A Higher rate Care and Mobility

    On I.S you will not get paid for your partner when she arrives, but you will get couple rate DP, but you will lose entitlement to your Severe Disability Premium if you are reciept of it, when she comes to live in your household.

  • How can they pay me DP couple rate,? i have asked them and they said they will pay me a single rate as the partner has no recourse to public funds.

    are you worried about your council tax, ie your partner has moved in and you have lost your single allowance supplement,
    on I.S you get full HB and CT benefit so if you get a new higher award you will get all or most of it paid anyway.
    A couple say on I.S next door to you, he was claiming for himself and her on I.S, would get all his CT paid,
    You should be the same I would imagine
