Checked with the DM, you will get both Couple DP and couple EDP.
and she explained it will be alright with immigration as the partner with the no right to recourse isnt claiming benefit, the customer the OP is not getting an increase in his personal allowance, he is entitled to extra money in the way of the DP and EDP, but is still being treated as a single claimant......
as the partner who has no NINO is not on the claim.
    Hi
I'm going to post an up-date but to say a BIG thank you to you for your kind help and advice, i was rude and it was out of order, i thank you sir for everything God bless you and your family.
  • Hi, Mikey bach and missmoney and everyone else, Thank you so much for all your help in my time of need, i'm going to post a long thread and hope i dont bore you all too much, I went today to see a private immigration lawyer, and got public transport for the first time using my electric wheelchair, which i can tell you is not easy, but i got there in the end, two buses there and two back, but today was such a nice day and it was the first time i have been out alone for about 8 months and it was great in the warm weather and seeing people out and about and i had a drink in my local city centre, anyway he told me that there is nothing to worry about its money being PAID TO ME in my own right, something that mikey bach told me in the first place ( how i wish i had listened to you in the first place, hard lesson learned) as long as my partner does not claim any benefots in his own name, it he cannot see a problem, he advised this, when they the D.W.P,pay you this extra bonus and it is a bonus in a way, i need to write to the D.W.P to ask then to first make sure that they have not made a mistake in overpaying me (even thou we know they have not) and to say again my partner has no recourse to public funds or to work, have they made a correct decision? in course they will say No decision correct, and he said that will be the end of it, it's money the Government pay's me and i have done all i can in telling them and therefore it is not taking additional public funds for my partner it's monies they pay me, when he told me this i was for a long time so happy, i started to cry, and i can tell you a grown man crying was not one of my happiest times, but he made me feel so happy and i could not believe how much better i felt, theses past few weeks have been so hard, and today i weighed myself and over theses past 3 week's i have lost 1.5 stones and i was so shocked to see i was now only 10 stones, i am underweight, so now i can begin to relax for a while and get on with living as they say, my life was very good up until 6 years ago where i worked for the prison service for the past 12 years, i had bowel problems and it was bowel cancer and i had to have a big operation and they removed my bowel and fitted me a stoma (colostomy bag) i was getting better then it moved to my prostate and now it has spread to parts of my other body, but i'm still here, i have around 3 to 4 years left, and the good news was when i shown my lawyer the problems i had he said to me he would do the further leave to remain for only £251 and i could not thanks him enough, as we were expecting to pay £650 onwards so were so happy with this, my first wife died some 8 years ago from a car crash and if anyone had said to me you will find love over the internet i would have said something like @#@'#@'# (never in a million years) how can you find love over a computer, but things went very slow we spoke everyday for two years before meeting up, then it went from there so its not been rushed into, it's 6 years in the making, now she is set to join me and this makes me so happy and to have had the help from strangers over the internet makes me so happy and to know people care touches me so much, i did work for most of my life and i paid my bit each week just like you good people do, and when it came to taking public funds i really didnt want to, i have only just started for the past 5 months started to claim D.L.A and the only reason why i took this is because i got a care package from social services and i get only 3 hours a day which sounds a lot but trust me its nothing, so at nights i pay a private man to come in and help me undress and get into bed and this take around 1.5 hours a night and when i'm paying £8.50 an hour, this D.L.A money is a God send to help pat towards my care, i know there are people out there who milk the system and soon i will have to move over the the new E.S.A and i know people who really are ill being forced off E.S.A, i just hope i dont get to much of a problem when i move over, i have had social workers saying claim community care grants and claim this, claim that, but i will not, all i want is to only take my fair share and if i could i would only take the single premiums on my benefit, others would be like oh yeah more money, i hope i am an honest person and i hope that people will have good luck all there lifes, what goes around comes around and you kind people helping me was great and i hope it all comes backaround to you some day.
I will of course keep you all updated, i am hoping to go to the airport to meet my partner but right now i could not do that, i hope to rest for a few weeks and then be able to book a taxi and make the trip to meet her.
God bless you all for your kind words and help and watch this space my friends!
  • One last thing, i still cannot believe that welfare rights so it so WRONG, they not only told me wrong advice once but twice, i have in writting from them that as i get the single rate in council tax 25% discount i would have to stop claiming, and they went on to say stop claiming it alltogether, i said yes ok, as they said you would be taking extra public funds if your partner comes and you claim so dont claim it, i was told today my the councils benefit team NO, they will look at my claim again and as i get I.S this will be paid in full even with a partner there who is subject to immigration control, you think your getting a good service and you relay on what theses people say and not only that i TRUSTED what they told me 100% and i called poor mickey b a lier is so many words, lets just say i have been sent a feedback form that i will be filling in a returning with my comments on, i would have gone mad but after my poor behaviour with micey b, i have learned yes we are all human and even when i abused him, he still offered his kind help Thanks

I just wish you well BM, you deserve all the happiness that I am sure
is going to come your way, you deserve it, I am sure you and your partner will be fine together...

Its nice to know our DM was correct, secretly hoping she was, take care and keep us posted.
Dont worry its hard when you are told so many conflicting things, knowing whats right, but you got there in the end..
If your partner gets a NINO and can stay then she can claim Carers Allowance for you
as I have said Welfare Rights offer a fantastic service but cant know all the in and outs its not possible in every case

    Take care
