I'm a little puzzled at this.
I'm familiar with the clerical component business having done it many times myself when I was working there.
I'm assuming it's been established somewhere that although the personal allowance is the single rate, the Premium is to be paid at the couple rate. I must admit I don't recall coming across this discrepancy before. It's been a while.
Assuming that is the case (excuse me, I've not searched) I'm not entirely sure one can ask for a lower rate than is due.
Benefits staff are not supposed to knowingly underpay someone.
Think of an ordinary claim, the most straightforward possible. On the claim form the applicant says "I don't need the full rate, just pay me 50 quid a week."
Although the processor could override the standard personal allowance and input a clerical component of £50, it just wouldn't seem right. It could look very dodgy for members of staff who don't have the same employment protections they once had.
I understand Broughton Man's position, I'm just not sure "but he didn't want the full rate" would be accepted if internal enquiries were to be made as to why full entitlement was witheld by the member of staff.0 -
UPDATE!!
Today i phoned Income support asked to speak to a manager, they called me back and said yes is HAS to be paid at the couples rate, but it has no effect on someone going for F.L.R or I.L.R so he said there is no problem in that so MIKEY was soooooooooooo right and for that i thank him sooooooooo much, and bow my own head in shame, it didnt say which on the premiuns would be paid at the couples rate, as i get the disability and the enhanced premiums, as i'm set to lose the severe D.P, so i shall have to wait and see what happens when i tell them of the change, i told this manager who called me the name of the person and he said he would be taking that up with them as he could also see on the computer that he has told me the same as i was telling him and that is was incorrect information, so if a team leader dosent know the rules God help us all, but thank you Mikey B your a great chap who deserves a medal for your help, sorry o jumped down your throat when you were only trying to help me

am so glad at long last they told you the correct information,
I know you will get couple DP, you may get couple EDP,
I will ask one of DMs specially for you tomorrow.
I couldnt see how one gov dept could give you something with one hand and take it away with the other,
so glad you are going to get it and keep it....
its only a little bit extra, but every little helps
I bet you cant wait now for your partner to get here..

I was at a loss as well how the office would deal with it,
the OP said no way did he want the couple DP when he was entitled to it.
You have to input it clerically, so I thought a DM would be able to give a decison on not to pay it it was going to effect the stay of his partner here.
But of course payment of the couple DP can be paid with out effecting their stay so all ok.
The Partner cant go on the claim no Nino, normally single customer pays single DP, to get it to pay couple DP you input code 18 this lets you overide the DP an you can then make it couple rate, this is the only way you can do it, and is approved by accruacy and the Line Manager.
Remenber when they failed their WFIs its the same principle.

This is very kind of you to do this for me by asking, again i'm so sorryfor being so rude, it was not right and i have learned a hard lesson from this, i was going to go mad a welfare rights today but from what i said to you i didnt go mad at them as i have learned a very hard lesson here, so i called welfare rights and said i know for sure they pay this at a couples rate, straight away he said NO there wrong, so then i told him of the number you gave me and he said i will call you back he went and checked there handbook, called me back and said yes your RIGHT, he said but i know he said they pay the single rate, so i said to him the letter you sent me with a full breakdown of what i was getting is wrong, and he said well it also says it should not have any problem with your partners immigration with it being public funds, BUT i am going to get that checked out with an Immigration lawyer just in case, i said to him, send me that piece so i can show it to an immigration lawyer so i am waiting for that to arrive in the next few days and then i will take to a immigration lawyer to double check, i cannot believe he didnt know, i asked him today to DOUBLE CHECK everything as one mistake can cost my parnter staying in this country, he then phoned me back about one hour later and said i have double checked everything and i have bad news, my HB that i get i can still get (thank God) thats £78.00 a week, but as i get the single rate in council tax i have to stop claiming it and pay it, which is around £19.00 a week, but if i get this extra benefit i will be ok as it will pay for my council tax anyway, so fingers crossed it will all work out ok, but the really funny thing i called a friend of mine today and he came to see me and he shown me his letter and his current letter for E.S.A and the premiums are for a single rate???? and he's been getting this for around 8 months, so i'm at a lost, i said to him you might want to call them and ask if its the same for you on E.S.A as i get Income support, so he said he would so i will let you know how he gets on, but thanks for all your help, one last question will the INCOME SUPPORT be paid at a single rate, as thats the one i really want the single rate for?? thanks again for your help my friend

Income Support will be paid at single rate £71.00
You will get the couples DP, definately £43.25
and I will find out if its couple EDP, as well, but its at least single rate £14.80
ESA rules and premiums are different to I.S,.
he must have DLA at some rate
and as you say it will pay your council tax0 -

Thank you so much, i get Income support and at the moment three premiums, The disabilty one the severe one and the enhanced, as i get Higher rate care and Mobility, i am in an electric wheelchair, my cancer has got worse to be honest and if i can just life for the next few years with my partner being here this will be a God send to me if we can get throught the F.L.R in a few months time we will be ok because i dont think i will be here for the I.L.R as my ilness has got worse, anyway thanks again for your help, it's still very strange to me that they pay single rate I.S but couple of the others, this is what i could not understand at all, but all sorted now thanks to your help

It was hard but you got there in the end, i really wish you both all the happiness in the world BMForums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0
