You have previously stated their is no proof of purchase so your £695 starting point is arbitrary. The depreciation of £100 a year is a random figure without basis.
The value of an item like this will always be subjective and a small claim court will not necessarily look at replacing the item but determine a fair figure for the damage caused and your inconvenience. The bag has a small mark on it - lets not over egg the cake here ..... your trying to be punitive to a young girl who may or may not have been un-professional .... there are always two sides to every story.
£100 seems a fair offer, accept it and move on.
You seem to know an awful lot about this, which I find fascinating as I've been back through Marianne's posts on this and nowhere does she mention the size of the mark or the age of the girl.
Personally, I think that you are Lisa, the Salon owner.
As for £100 seems fair, you are having a laugh dear. Marianne, please do take this all the way. I'd suggest even copying this thread and 'In1tt0win1t' posts as they are seemingly evidential of an attempt to bully you into a resolution which suits the salon.0 -
Very suspicious postings from In1tt0win1t glad they have all been quoted in case they mysteriously disappear!Spreading a little Christmas joy all year round :santa2:0

I thought so too, but also that the poster was implying legal knowledge when they used the phrase "my professional opinion". That may or may not be the case, but I didnt like the unfounded suggestion that a court would view the OP as litiginous purely for not being willing to accept a settlement she patently thought unfair.0

I wonder what the damaged bag is worth.
This is what I would do op..
seek professional advice on repairing it, it's likely not possible to do so, but you can at least demonstrate you tried to mitigate your losses
sell the damaged one (somebody might be interested, probably at a very low price mind)
buy a like for like one from eBay
sue for the difference in price
I suspect they know they are on very weak grounds and trying to get out of this mess as cheaply as possible, including underhand tactics on here0 -
Are some of you seriously saying that the salon owner has by some miracle found a thread about her on a forum and has joined up in disguise to comment about it?0

I am not 'working' for the other side and have gathered all the information said from the postings ie the stain was the size of a 50p / the new stylist without insurance but has now ... Just because I don't wholly support Mariannes view doesn't mean I support the Salon Owners either I am being pragmatic based on experience and advise Marianne that her claim for £495 is excessive and a £100 offer is fair.0

Some of these postings are completely ludicrous and are laughable. Of course a claim can be viewed as being litigous if a fair offer is rejected in favour of going to court.
As for producing these postings in court as some sort of evidence really does show a level of naivete of the court process and what would be admissable.0 -

Yes.
Put yourself in the shoes of the salon owner, chances are you'd do a bit of googling to see if you could find a similar case and what the outcomes of that were. You'd do some research.
It's not a stretch to imagine the search string used would be something along the lines of
hair salon dye on bag
hairdresser dye on bag
Both of which bring up this thread first on google.
So yes, I'm saying it's more than plausible. Research is what I would do if this happened to me, either as a customer or a business owner.0 -
I am slightly offended that I seen to be one and the same as the author of this :
'Hi, olas just foned her insurance company + the reason they wudnt tell you anythin is bcus altho shes insured now she wasnt at the time, wich i wasnt aware of so her insurance company as advised her to pay sum money 2wards the damage of wich shes willing 2 pay £150 plus u can claim yor groupon money back by emailing groupon customer services, i hope this helps.'
Its a great conspiracy theory.0
