Green Leaf Finance - PLEASE HELP!

  • I too have been a victim of Greenleaf and MyloanSearch, surprise surprise there is only an answer machine for GreenLeaf and the MyloanSearch companies telephone is dead. I have today spoken to Trading Standards and I suggest that anyone affected do the same.

    Initially my bank refunded the money but as they have received documentation from a Jonathan May stating that the transaction was authorised by me they are taking the money back and suggest I speak to the company direct (would love to).

    Citizens advice suggest you send a letter to the company concerned and ask for justification for the amount taken and ask for a refund within 7 to 14 days if no response contact CAB again.

    I don't hold out much hope of getting my money back

    Ozmanthus, here's their justification, (taken from their website) i suppose you didn't read their terms and conditions ?

    Fees
    We charge a fee of up to £49.99 for providing our Personal Service to you for acting as your Exclusive Personal Finance Broker, this exclusivity lasts for a period of 6 months from the date of your application with us. We specify the fee as part of our communications with you. To clarify this, our fee is taken once your application for a loan has been accepted by one or more of our Lenders, this from our approved Bank of Lenders. To facilitate us processing payments and repayments, you authorise us to retain your charge, credit and or debit card details. If a Lender or Financier makes you a Loan or Finance offer, in addition to the fee we may also receive a variable commission from the lender or financier and you agree that we may retain it.

    This is a PERSONAL SERVICE that we provide to you our client. Once an application has been processed the fee charged cannot be cancelled or refunded. However, under Financial Services (Distance Marketing) Regulations 2004, you do have a right to cancel any loan agreement brokered by us on your behalf, within 14 days of receiving the terms and conditions off the Lender and receive a refund of any interest charged by the Lender in that 14 day period (the refund of any interest charged by a Lender or other third party has to be reclaimed directly from them), The Company is not responsible if you have accepted charges made or levied by any third party Lender or Advisor that you have or may of appointed or entered into by way of a separate agreement, not conducted through The Company. If you want to cancel a Loan within 14 days, you must write to the Lender directly quoting their reference number, stating that you want to cancel the agreement. Also write to The Company notifying us of your request, so that we may notify the Lenders on your behalf (we would advise that you send your cancellation request by recorded delivery as proof).

    If you do not receive any offers of a loan within 6 months of your application you may be entitled to a refund of your application fee. In this event we will refund your fee (less an admin charge of £5.00) within 21 days of the date on which we receive your written request for a refund of your application fee. However, you cannot cancel your application and expect a refund if you have accepted a loan during our exclusive 6 month relationship period, even if, in your opinion it was not directly brokered by us, as any such loan will be deemed that it has been brokered by us for you within the 6 months from the date of your application. Prior to issuing any refund, we may instigate a Credit Check to confirm this. Any requests for a refund should be made in writing to the address at the bottom of this site. A refund cannot be requested until six months after the fee has been charged, to ensure you have not accepted any loan offers.

    You must enclose a stamped and addressed envelop for our reply, which will be within 21 days. If we provide services other than acting as a loan or finance broker, we shall be entitled to charge a fee for those services. In the event a guarantor is required to guarantee the repayments of any loan brokered, this will be deemed an acceptable offer of an unsecured loan, as any such loan is not secured against the guarantors or lenders property.

    I have had £39.99 taken out of my account last month and did not authorise it. Wish someone could get this back for us all.

    That's the problem.

    The Terms and conditions are posted just above your post which clearly states they are taking a fee. Despite that, you still declare you did not authorise the withdrawal.

    The icing on the cake, and the VERY REASON these companies will continue to flourish, is that you don't seem at all prepared to go and get your money back but would rather sit back and hope someone else does it and sends you money.

    A quick look through the forum and you will see im in the same position but with 1 difference
    Im fighting tooth and nail to get my money refunded while using the advice from here to guide me.
    Fight back,never quit,dont stop till you get your refund otherwise your sending a very clear message to these companys that its ok to conduct business this way
    Step 1 send a complaint recorded delivery requesting a refund..if this doesnt work
    Step 2 send an official notice of action
    (Your address)
    (The Owner/Manager’s name or The Manager)
    (Company address)
    Dear (owner/manager’s name or Sir/Madam)
    RE: Final Letter Before Action
    I enclose a copy of the letter I wrote to you on (insert date of letter(s)) and I have not yet had a (response/satisfactory response).
    I have given you reasonable opportunity to resolve my complaint. You have failed to do so.
    I have now been left with no alternative but to seek legal redress through the courts. Unless this matter is satisfactorily resolved within the next 14 days by (explain what you want the company to do), I will start legal proceedings without further reference to you. The costs of starting this action will also be added to my claim.

    How people can run up debt fall behind on payments mess their credit up, then type in loans on google then get a phone call from a stranger telling them they have been approved for a loan Then give them your bank details is really beyond me.

    WHY THE HELL DO YOU MUPPETS FALL FOR THIS SH*T

    Because rather than suffering by cutting back on things they think that getting more debt will sort thier debt out......madness..
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    No sooner has some helpful person posted the T&C's here which quite clearly state that it was a FEE, then the next punter comes along accusing them of making an unauthorised withdrawl.

    I am afraid the !!!!less will always be the !!!!less and no matter what legislation is put in place, the unscrupulous will always find was of legally (just about) extracting money from those who for a variety of reasons are aither so dseperate, lazy, stupid or infirm as to not read and understand the T&Cs.

    Frankly I give up.

    It beats me how these payday companies and brokers are able to guess punters bank details so accurately, time after time, that lead to all these unauthorised fees being withdrawn........
    I used to think that good grammar is important, but now I know that good wine is importanter.

    I will openly admit i should of researched the company i used before entering any details,but as ive said before- there sites are designed to mislead and to make you believe there offering you a loan AS A LENDER not a broker.
    After they have your details it becomes more obvious what there actual intention is and thats to charge you....but by then its too late
    Its easy to hide behind your monitor and accuse everybody of being stupid/dumb etc etc but this doesnt help one bit.
    if you aint got anything useful to say then say nothing
