Although you attend the Court buildings, you don't actually go into a Courtroom.
A Judge has to grant the order, so a budding BR may well be interviewed 'in chambers'...the Judge's office, [or near enough.].
Judges tend to be very sympathetic..they are comprehensively trained in dealing with people in vulnerable positions [as a budding BR is]....but they have to be satisfied in themselves, the petitioner is fully aware of the duties and implications of BR.
Hence, asking the questions regarding what advice has been received?
The last thing a Judge wants is to find someone before them, trying to overturn the BR petition on the grounds that 'nobody told them what it was going to be like!'
Once the petition is granted, it is quite difficult to undo things.
But, even with divorce [I am a serial divorcee] the petition is not granted until the Judge is satisfied that is what both parties actually want.
Same with formal legal adoption......[my daughter took the 'pregnant-pause' suspense a little too far, perhaps....].....I could see her mouthing 'eeny-meany-miney-mo'....!!!
Whilst advice, legal or not, isn't a requirement of Law with BR... because the Bankruptcy is a very powerful legal instrument, the Judge has to be doubly sure the Petitioner understand what it is they are undertaking, since it is legally binding.No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
I got some advice yesterday and was told basically get £700 go to court with all the forms and bang your bankrupt!!!!!
Are the forms difficult to do? obviously to raise this I need to stop paying any bills so I can afford to raise the cash quickly, how did everyone else in my situation go about it?
Also I have more going out than coming in but once I go bankrupt I will have extra money, so wont i have to pay the OR for the next three years?
and is overtime taken into consideration as I have to do it to live0 -
OP As you are going bankrupt the debt to mil does not make much difference, but if that is the tipping point have you considered the status of these loans from mil. Is anything in writing that proves she loaned it to you? Surely any money handed over was as much for your wife as yourself so why does mil expect you and not her to repay it?Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. The forms are not difficult as such, just time consuming plus sometimes you need advice as to what information the question is actually asking for. I was glad I completed mine with an expert. I didn't stop paying any bills at all, just the creditors. If you can't afford to pay bills and save any money towards the fees the OR is not going to be able to rrequest any money from you at all."Our prime purpose in this life is to help others. Sorry if I sound very thick but, If I had say £10.00 a month left after bills and debts and went bankrupt because of the debt been wiped say I has £100 left now per month would the OR expect to have that as I now have a surplus???0

I currently have to catch the bus to work and then walk 2 miles from the stop to get there on time am I allowed to take driving lessons or is that deemed as a luxury???0

My hubby was declared B/R in nov last year, I went B/r may this year, best thing we ever did, we both felt lowest of the low at the time, but the releif of not getting letters and phone calls is practicly immediate, our lives have not changed but a dark cloud has lifted, I did both of ours myself, the form filling I spread out over a week as its endless as you need to gather evidence of who you owe, if you get working tax credit or other benefits you dont have to pay the court fee £175 look on sites to see if you qualify, my O/R was brilliant the dont condem you they just need to do their job.. good luck to you.0

Im concerend how long its going to take me to raise this £700 to go bankrupt, do I have to prove how much rent I pay? do I have to show a tenancy agreement??
What if I lived with my partner and paid half of everything but cos im not on the agreement I cant prove I pay rent??
If I did then go Bankrupt I would end up paying for 3 years wouldnt I.0
