    Usually no problem with phone contracts or sky. Assuming that you would prefer to keep them on.

    As said, basic may be allowed in any IPA "budget" calculations, but you can have more if you are prepared to fund it out of surplus.

    Phone contracts specifically ARE usually allowed, but just that excessive amounts may be disallowed for the purposes of any IPA calculations.

    However, if you did want an "out" on the phone/sky contracts, you could cancel them, and anything left unpaid (including months left) on the contract would fall into the bankruptcy.

  • Im not bothered about the phone contracts I need to get out of debt so I cannot choose to be picky or moan really, this is not a road I wanted to go down and foolishly tried to borrow more money to get ahead which did not work. Once the fee is paid how long does it take to go BR?

    Once you have gone to court, paid the the fees and they have checked your paperwork and stamped by the judge, then your are officially BR.

    Can take a half hour or 3, depends how busy they are on the day.

    Before you go to court to file for BR you need to have taken legal advice, for instance from CAB, the Judge will ask who you have obtained legal advice from when they see you and usually will not approve the BR unless you have done so.
    Many courts require you to make an appointment to submit your forms/pay/see Judge and become BR and some courts have a turn up and wait your turn process, check what your court does first and make an appointment if needed.
    Allow plenty of time to fill in the BR forms before you go to court, I had face to face help from an expert and it still took me 3.5 hours to do mine and that was with all my evidence beside me and prepared.

  • So if I dont seek legal advice first this could actually put a stop on my BR. Is the legal advice to ensure I have looked at all the other possible solutions as BR should be a last resort??

    Doesn't have to be legal advice. Can be from somewhere like debt advisors CAB, CCCS, National Debtline etc.....

    Basically, the judge/clerk at the court will normally ask what advice you have taken that BR is advisable in your case, before they will look at granting the BR.

    It's just a double check to make sure you have had some professional advice on the situation and consequences.

  • Have any of you that have posted been Bankrupt, I was just wondering if its as daunting as I feel and if it does offer a huge relief and what is life like licing as a bankruptcy.

    I was made BR a couple of weeks back. I haven't felt any relief, just shame. That probably says more about me though than the situation, many people say they feel relief.

  • You don't need to take legal, or any advice, for that matter. You probably won't even see the Judge.
