Keep up the excellent work, me handsome, even if you are from Devon.

As we say on t'other side of the Tamar, there are only three types of people. The Cornish, The English and them from Devon. Still someone had to be didn't um. :D;)
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

I'm loving this! I've also had a ticket from UKPC and trying to find ways to pee them off. Regarding cornwall/devon, I've recently moved from plymouth to the bad side of the bridge (saltash) although may be quickly moving back as they're own about increasing the toll to £2!! I'll need a loan each year!

I've been following so many cases on another forum that just sort of fizzle out.
Bargepole knows the forum I mean and we know each other through it. Or at least I know him......
Can I just add a note of congratulation to your efforts Bargepole.
Please keep it going to fulfilment as I am giving out small leaflets in several private car parks (Metrocentre mostly) advising of this topic in this forum and to take no notice of UKPC who monitor it for their financial gain.
I have a sample of the sort of leaflet I give out if anyone needs one to copy. They're business card size, double sided and with all the relevant info for drivers.
I usually stick them into the bag holding the ticket.
I do this as a hobby while I wait for the wife to finish shopping and it helps me amuse myself by following the parking "attendants" around.

Guys - I've asked Crabman to move posts 67 onwards out of this topic. If you want to get involved in pointless bickering over a subject not relevant to this thread, please do it elsewhere.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

There's not been anything relevant from #57 on if you want to nit pick.

Now received a standard "Notice of Intended Litigation" letter from DR+, full of the usual bow locks.

    Sent them this reply:

    Dear Ms Barker,

I am in receipt of your "Notice of Intended Litigation" dated 3rd September, your ref. 78963.

As stated in my previous messages to your company, I do not acknowledge any lawful debt to UK Parking Control Ltd., in the sum stated or any amount at all

I note that you state that your "solicitor may issue County Court proceedings". Please be advised that any such Claim will be vigorously defended, and the costs of such defence will be submitted to the Court to be awarded against the Claimant.

I should also point out a grammatical error in the black box at the bottom right of your letter "we will seek to recover the principle sum shown above" - this should, of course, be principal.

I would further point out, having looked at your website, it says that "we regularly and consistently issue CCJs to non-payers". Obviously this is complete nonsense, only a Court can issue a CCJ after a Claim has been made and either upheld by a Judge at a hearing, or by default if undefended. I am sure that, as Litigation Manager, you are fully aware of Civil Procedures in the county court, and will seek to get this corrected at the earliest opportunity.

You also mention advice given on web forums, and claim to have obtained CCJs against non-payers of parking invoices. I am one of a number of people who regularly give advice on various web forums (principally moneysavingexpert.com and pepipoo.com) and have yet to see any examples of any county court claims brought by UKPC / DR+. In fact, following a Freedom of Information request to the Ministry of Justice, I have discovered that the number of such claims made by UKPC in 2011 was nil. I therefore suspect that the scrolling case numbers on your website are for matters other than parking charges, and accordingly I have made a complaint to the OFT and the Advertising Standards Authority regarding the misleading nature of your site.

Finally, I confirm that, in accordance with the contractual terms stated in my letter of 11 June to UKPC, your latest correspondence has generated a further £90 charge, for which I have today sent a further invoice to UKPC, making a total of £450 which they now owe me. When I receive their County Court Claim (no doubt hand-delivered by Lord Lucan riding Shergar on his way to the Pope's wedding) I will be counter-claiming for this amount plus costs.

    Yours faithfully

I thought you had an online company chasing the debt, and issueing a County Court Claim?
