item accidently sent to wrong address and has been stolen

    The essence of the question, is, was your old address still on your Paypal account as the delivery address for the payment?

    Because even if you updated your address, it does not mean that this was made to your default address, unless you selected it to be that.

    I use Paypal/eBay postage to post most items, and because the whole interface when printing UK postage now runs solely through eBay (i.e. as a seller you never log in to your Paypal account; it's automatically linked to your eBay account) I have found that on occasion the address it prints out varies slightly from the address as detailed in the email payment notification from Paypal. The OP's seller might have used this method of postage, the OP hasn't updated their address properly on both eBay and Paypal, and so the eBay postage has defaulted to the postal address on eBay.

    I can't see how the seller is at fault here; it's a lesson learned and for small-value items it isn't really worth it to pursue the thieves at the old address.

    I agree that seller is not at fault in this case, personally I would always check the paypal address in paypal to be sure. I am not up to speed on all, but I believe the eBay seller protection does cover the seller in these cases, when payment made by Paypal. But solely Paypal case, than seller have to have used that address, otherwise that is sellers fault, even if the buyer did the initial mistake in this case.

    Unaware of the value of the loss, I would take it as a lessons learnt, but if it was high value item, for sure seller must make sure correct Paypal has been used.

    OP has every right to open a claim for item not received, because guess what?

    He hasn't received the item!

    In case you missed the OP, but he confirmed that the parcel was delivered, but the contents were stolen after it was delivered and before he got it.

    I always thought the line between moneysaving and outright fraud was quite distinct, clearly you do not think so.

    Listen, ebay rules are clear on this. It says that you need to ship to the paypal address making you protected as a seller in the case of a dispute. If you don't, then the buyer hasn't received the item and you are out of pocket. Simple.

    I always click on 'view paypal transaction' when I ship something out and use that address. How easy is that?

    It's not fraud!!! It's called a mistake which was made by the seller. A potentially pricey lesson learned. End of.

    Wrong.
    Ebay state the following on the relevant page in "my ebay"
    Primary postal address.
    - This is where you'd like to receive items you purchase.

    It is paypal that state that you need to ship to the paypal address.

    And whether it is the PayPal address or eBay address, are we overlooking the FACT the item has been DELIVERED?

    OP, it's down to you.

    Why should the seller pay for YOUR mistake and YOUR thieving (ex)neighbours? If the thieving neighbours had stolen the parcel whilst you still lived there would you be posting?

    He said the parcel had been delivered to the OLD address, not his new address, therefore, it wasn't delivered to him, was it?

    I haven't a clue why you keep spouting 'fraud' either.

    If a parcel for me goes to my old address, when I've paid with Paypal and Paypal tells the seller to send the item to my new address, that's tough, and I would have no hesitation to put a claim in for item not received.

    There's no fraud in that situation whatsoever.

    The OP hasn't said whether he deleted his old address from Paypal before paying for it.
    If he hadn't then his original address will probably be the default address, which the seller will have been told to post to.
