UKPC parking charge - should I pay?

    No, it's not OK to ignore them. Go to the NEWBIES sticky thread and read advice on there.

    I have just one a POPLA appeal against UKPC, so it will work if you follow the guidance and make appeals:

    1. appeal 1 to UKPC. This appeal with fail.
    2. appeal 2 to POPLA, using wording from the NEWBIES thread. This is very likely to win if you follow the correct wording.

    Hi,

    I got a parking ticket yesterday from UKPC at crown point in Leeds. However, i received the ticket in the staff car park, which I hold a permit for.

    I parked in the car park and went into the city centre. When I got back, I noticed the ticket which said 'left the site'. And a £60 fine, raising up to £100 if that is not paid.

    The ticket says they will request the registered keepers details from the DVLA of the parking charge remains unpaid.

    Below this, it also states that the company work in accordance with the BPA's code of practice.

    I've seen a lot of posts saying to just ignore it, and this post probably is the same but just want the reassurance, should I reply to them? Should I pay the fine? As I don't really want to be going to court.

  • This would be my advice based on my mate's experience. Ticket issued for £100vafter 'vehicle owner left site'. First letter from UKPC recieved (and ignored) about 3 weeks after the event.
    The first 'Final reminder' was sent, again from UKPC, one month later - again for £100. The please return payment to address was a PO Box address.
    1 month later a third letter was sent from another PO Box address, this time from DRP (debt Recovery Plus Ltd) - the charge had been raised to £160. Two weeks after this they sent another letter to similar effect, again from DRP. A third letter follwoed two weeks after this requesting a reduced payment offer - only £130 this time.
    The next letter came from Zenith collections (based at another PO Box) two weeks after this with the charge raised back to £160. A second letter from Zenith followed 2 weeks after this with a reduced settlement price of £80.
    A further (and final) letter came from SCS (small claim solicitors) 5 weeks after this requesting full payment again.
    Nothing has been received since and this was over 6 months ago. Based on this experience my advice would be :

    Don't respond. Don't visit any web address they suggest. Don't scan a QR code from their letters. Don't get stressed out by this and don't pay.

    That's a fairly standard route once a PCN is ignored. However, the PPC has up to six years to pursue the debt in the county court, so until six years have played themselves out, there will be no closure for your mate. And a real problem if he moves address in that time.

    By using the appeals procedures (with advice from the forum) the charge can be killed in the space of a few weeks - dead!

    Since Beavis, PPCs are starting to become more litigious - UKPC have just commenced issuing court papers in numbers not previously seen.

    The newbie seeking help in post #33 has every prospect of avoiding court; your mate doesn't (short of coughing up).

    In the majority of cases, no one these days is advised to ignore if there is an appeal window open to them.

    Do we really take people to court and win?
    Amateur lawyers posting on internet forums often advise people to ignore parking charges, claiming that they’re not enforceable by law. This is bad advice.
    In fact Parking Companies take people to court every month and in most cases the judge finds in our favour, on the basis that:
    the parking charge was issued correctly
    our signage was clear and properly displayed
    and the charge made was fair.
    In this case you would be issued with a county court judgement (CCJ) detailing the amount you need to pay us. Taking into account the original charge plus interest, legal expenses and costs, this may work out in excess of £300.
    A CCJ could have a negative effect on your credit rating. Unless you pay it within one month and then pay an additional fee for the details to be removed from your records, the CCJ will remain on your credit file for six years.
    Each month people receive CCJ’s from the civil courts after trying to avoid paying private parking charges. Here are a few examples from UKPC:

    Common defences and why they don't work
    The charge is unfair
    When we take them to court, people often claim that they decided not to pay the parking charge as they felt it was unfair. However, we have never had a case where the judge has accepted this argument.
    By parking at the site you indicated that you agreed to our terms, including the charges we’re entitled to make if you park in breach of the rules.
    In the recent landmark case of Parking Eye Ltd v Barry Beavis [2015] EWCA Civ 402, the Court of Appeal unambiguously and unanimously approved the issuance of private parking charges by private operators. The Court made reference to private parking charges being justified commercially, socially and benefiting the community as a whole. Creating a new judicial test, the Court assessed the validity of the issued charge by deciding whether it was ‘extravagant and unconscionable’, which sets a high bar for parking charges to be deemed unenforceable. In the case, an £85.00 charge issued by a private parking company was considered fully enforceable.
    I wasn’t driving the car
    This is a very common defence but a risky one. In many cases we’ll have photographic evidence to prove that you were the person who parked the car on-site.
    If you state in court that you weren’t driving the car but are found to be lying, this could be considered as perjury. This is defined as the deliberate, willful giving of false, misleading, or incomplete testimony under oath, and is a serious criminal offence.
