    I don't see any contradiction and I think that you can leave without any penalties. I am not alone in thinking this, but the majority have a different opinion. Three just say that you cannot leave and blackmail the customers by threats of trashed credit history and debt collectors.

    I have also just read the terms and it specifically stated under section 4 of the t's and c's:

    4. Variations to your agreement or prices
    4.1 We may vary any of the terms of your agreement, including our Packages, on the following basis:(a) any updated Packages and new terms will be available on our website and on request to Three Customer Services;
    (b) we will let you know at least one month in advance if we decide to:
    (i) discontinue your Package; or
    (ii) make any variations to your agreement which are likely to be of detriment to you; or
    (iii) increase the fixed periodic charges for your Package (if applicable) by an amount which is more than the percentage increase in the Retail Prices Index Figure (or any future equivalent) in any twelve month period.You can end the agreement for such variations as explained in Section 10.

    Subject to the above, you will not be able to end the agreement if such variation or increase:
    (i) is due to changes to the law, government regulation or licence which affect us; or
    (ii) relates solely to Additional Services; or
    (iii) relates solely to Add-on(s) (if applicable to you). In such circumstances you will not be able to end your agreement but you will be able to cancel the Add-on(s) by giving us 30 days’ written notice; and
    (c) if you carry on using Three Services after the variation commences, you will be deemed to have accepted the variation.

    Pay the Line rental x months left in an early termination fee and leave Three.

    I know it's sound flips, but I assume you did read the T&C that said it was possible when you signed up...

    In fact the T&C say that you can leave without any penalties.

    We had a virgin media contract and when they increased the price we were allowed to cancel the contract because they had moved the goalposts...this is exactly the same as what three have done but three won't allow the contract to be cancelled early.

    It comes down to "reasonableness", mobile companies are getting away with the price increase, because they have sneakily done it in line with inflation.

    The price increase of 3.6% has been deemed reasonable, therefore anybody will have difficulty trying to cancel their contract or arguing with their provider because of this.

    When Virgin did it, some prices were greater than the 3-4%, so Virgin themselves gave customers the option to cancel their contracts without penalty. I know, because I did it.

    Woke up to this unpleasant text today as well. Here is what I have sent to Three;

    Dear Three,

    I have received an unpleasant text from you notifying my that you are increasing the cost of my monthly contract. I have been a 3 customer for many years and just over 18 months ago joined your One Plan on a Premium rate contract of £35. For you to then increase this already high contract is an insult and speaks very badly of you as an organisation. I shows a complete disrespect for the trust and loyalty of your premium customers.

    As per section 10.1 (d)

    10.1 You may end this agreement in the following ways:
    (d) Within one month of a detrimental variation to your agreement.
    You can end the agreement within one month of us telling
    you about a variation to your agreement (which includes your Package) which is likely to be of detriment to you. You must give notice to Three Customer Services within that month and your agreement will finish at the end of that month once we receive your notice.
    (A Cancellation Fee will not be charged.)

    Is see this increase as likely to be of detriment to me.

    My contract is coming up for renewal in 6 months time and I had intended to continue with a further 24 month contract at the rate of £35 a month. Given this increase during a contract signed in good faith it is now based on how you deal with this complaint that will dictate if I stay with you for a further contract term of 24 months or if I leave.

    I would like you to resolve this issue in one of the following two ways.

    1. My preferred resolution. Do not increase my monthly contract cost.

    2. If you are unable to provide me with the service I signed up for at the original cost I wish to cancel my agreement in line with section 10.1 (d) of the terms and conditions.

    I will be publishing this and any further communications on this matter on several consumer websites.

    I am very upset to be treated like this and have always sung Three's praises. I have found your service to be faultless and excellent in every way up to this point. I would be very disappointed to be forced to leave but I find the way you treat me as a premium customer to be unacceptable.

    I have a little over 6 months left to go on this contract. It will be interesting to see if Three will choose to lose me as a customer for the sake of £6.

    Ultimately for the majority of people the increase will be up to £12 per year. With Threes unlimited data and massive minutes allowances for next to nothing I have very little doubt in my mind that a large percentage of people who took Three would have still chose them had the price been 3.6% higher at the time of purchase. I don't necessarily like the price increase as I had the same thing on Orange but with phone line rental prices at home going up every year I guess I was used to it by now :p. Rather than threatening to cancel over £6 as the above poster is looking to do why not just ask if they can change your tariff to limit or avoid the price increase? If this is anything like Orange and Tmobiles increase then you will not be able to terminate without charge.
