    Seeing as, at 61, he was still speeding in the 60 parts (speeding is absolute - you're either above or below the posted limit). If he started trying to defend it on the basis of the signage then there's no reason at all that the Court has to honour the guidelines about not prosecuting within a certain margin.

    Especially as, like others have pointed out, his speedo will probably have been indicating considerably more than the 61 he was doing - up to about 67 given the 10% over-read that's allowed.

    Nope and act of stupidity that essentially asks plod to have their trousers down and not even pass them the lurpak.

    Sounds liek this is a serial offender. Doing an indicated 70 in a 50mph limit is just daft. They might have got away with it this time but do you want to be the copper telling someone's family they've been killed because someone:

    a. never learnt their lesson
    b. wanted to be somewhere 30 seconds quicker than they would have been
    c. never got told to slow down because it's "a victimless crime"

    I don't mind people going a bit quicker int he right places, I'm all for the move to 80mph on the motorway but if someone is prepared to break the limit this often and by that much then they deserve to be punished before there is a victim.

    You can't close the stable door etc....

    That was said in a casual conversation from me to him before the letter came through which stated his speed. We wouldn't defend it unless we know he was absolutely in the right which he isn't.

    In the eyes of the law, he has done wrong , I'm not disputing anything.

    don't worry. Never suggesting otherwise.

    It's Harry who seems to think it's ok to drive everywhere as fast as you like because hey "it's a victimless crime" which it is until you have a crash and kill or injure some poor soul because you were breaking the law in the first place.

    I do agree with what your saying and I also don't want the phone call to say he's been in an accident.

    He has the points over a 5 year period. Every case is different and it is easy to say he is a serial offender ( he is I know ! ) and judge without knowing the situation of each one. I won't go into detail as there as far too many points to discuss. :) I don't agree with all the points that he has got, and some of them he should have disputed.

    In his defence he does do a lot of miles so he is on the road a lot more than the average person. He isn't reckless, far from it but he is a speed freak, and he has calmed down in that department.

    Maybe this time he will learn... :o

    Couple of points, can't be bothered to quote the indicated posts as it's been a long day and I'm in zombie mode.

    It may well not have been an indicated 70. Yes car speedos can overread by up to 10%+6.25 mph but not all do. Some are actually bang on. My GF's 200SX is like this. Speedo matches GPS unless the tyres are in dire need of replacing.

    a 61 reading when doing 60 is well within the error margin of most camera devices. The reason they generally allow up to 10%+3 before prosecuting isn't a case of being generous, or saying it's ok to speed just a little bit, it's because if they didn't, all the people who were only a few mph over would quickly clog up the court system with legitimate concerns about the accuracy of the device. This would be costly and the cases would be likely to succeed. However if you're doing 61 in a 50 and say "but the camera could be overreading, I was only doing 56 and you don't prosecute until 57" the answer is "56 is still speeding".

    The OPs friends case in 2007 is a perfect example of why the camera system is a poor substitute for proper policing. Chances are all 3 offences were committed before the first NIP even arrived in the post. This typically happens when a person genuinely doesn't know the limit on a particular stretch of road, for whatever reason.

    If you had a proper copper pull them over and give them a telling off, or even a fine and points. The person then becomes aware of the actual speed limit for that stretch and most make sure to alter their driving accordingly.

    what road was it? i know the area and have never seen any bad signage.
    I know when the by pass had works on loads of people got done on that for speeding and that;s the only one i can think of?
