    Unless he is hiding behind a Limited company (highly unlikely), you can always use the Court system to get your cash back.

    he will know this if he is intelligent and will (hopefully) do the decent thing and cough-up.

    Just checked online and the letter has been signed for. OH will call him later and ask what he wants to do. We've called around for quotes and we can get the work all done for £1500, so it would be better financially for him to pay for the work rather than give us all our money back. BUT, we will see how he's going to play.

    Just another quick question. If he decides to be a complete ar*e hole, we have had quotes that cover all the work for £1500 roughly. Would anyone do the work? If we write it off obviously we've lost 4.7k

    Slow down everyone. What EXACTLY is wrong with the car?

    Are we saying the car drove perfectly and then 5 miles down the road it started grinding? What's this about blown turbos and particulate filters?

    What indication is that the seller knew there were problems and sold the car on knowingly?

    The diagnostic test showed that the gearbox needs a rebuild urgently. Its an EGS 6 speed semi-auto. There are also 2 other main problems which I don't have the paperwork on hand to note. Citroen quoted £3,000 but obviously thats there overpriced quote.

    We have gathered together a lot of evidence that he is a trader although he's stating he isn't and as he's a trader we have rights. The log book was not in his name either and as a private seller, it would have been. Ive printed off numerous adverts on cars and machinery he was selling or has been selling over the past 2 weeks. Auto trader have confirmed he is a trader and sent us proof and Trading standards and CAB have said that we've done the right legal act in sending the letter. Also as a trader we have protection under SOGA 1979 which means that goods need to be fit for purpose.

    As already stated we have no transport at all. This guy knew I was very ill and 2 different mechanics have said that he would of known it wasn't working right and as a dealer he has to disclose this.

    This was all our savings and we've already spent out £200 on a wheel bearing and the diagnostic test and yesterday we had to put 6 months tax on it.

    OH is calling the seller later to ask what his intentions are, then we can take it from there. The cheapest option for him would be to pay for the work which has been quoted elsewhere for around £1500.

    We cannot afford to loose £4700.

    What does the advert actually say? Dependent on that you coud be looking at Small Claims citing the misdescription Act 1967.

    Also, how have Autotrader confirmed he is a trader? Have you seen this proof? Autotrader are governed by the Data Protection Act so cannot give you that information. They will pass it on to Trading Standards if requested but my understanding is they cannot confirm to you directly if he is a trader or not.

    They may well have sold it due to the problems you list.

    PP I will be following your post, and fight, with interest as it seems we are in the same boat.

    My OH spoke to our seller a little while ago who basically said we have no rights (will get the full story when he comes home from work) so I guess our fight is now beginning...

    My letter has gone recorded delivery today

    Send off a V888 form as well, do it today if possible as this can take 4 weeks or so to come back. You can print a copy here:

    It will cost you £5 to gain all the previous keepers of your car, but could be very worth it in the long run!

    I have but can't find her number? Ive tried one number but wasn't the right address. How would I find out? If not, should I send a letter?
