No, should of declared it SORN'd :doh: Surrender it immediately!
We had to tax it or the insurance then becomes invalid etc. If someone was to set light to the car on the drive with no tax or insurance, then everything would be invalid. I can get a refund on the tax at any time, so am only loosing £11 per month.To repeat what others have said, requires education, to challenge it,requires brains!FEB GC/DIESEL £200/4 WEEKS0 -

Yes. My OH used to work in car insurance. If theres no tax or a valid MOT on a car then the insurance is void. If you were in a car accident without either, they would not pay out.To repeat what others have said, requires education, to challenge it,requires brains!FEB GC/DIESEL £200/4 WEEKS0 -

Goes against what a lot of people say regularly on here, which is why I asked.
Lack of an MoT certainly doesn't invalidate insurance as a matter of course and I don't see why not taxing it would.
My Land Rover stands untaxed and unMoTd on my drive right now. I'm sure my insurance would pay if it was stolen.
You are unlikely to have an accident on your driveway anyway.0 -

We have gathered together a lot of evidence that he is a trader although he's stating he isn't and as he's a trader we have rights. The log book was not in his name either and as a private seller, it would have been. Ive printed off numerous adverts on cars and machinery he was selling or has been selling over the past 2 weeks. Auto trader have confirmed he is a trader and sent us proof and Trading standards and CAB have said that we've done the right legal act in sending the letter. Also as a trader we have protection under SOGA 1979 which means that goods need to be fit for purpose.
As already stated we have no transport at all. This guy knew I was very ill and 2 different mechanics have said that he would of known it wasn't working right and as a dealer he has to disclose this.
This was all our savings and we've already spent out £200 on a wheel bearing and the diagnostic test and yesterday we had to put 6 months tax on it.
OH is calling the seller later to ask what his intentions are, then we can take it from there. The cheapest option for him would be to pay for the work which has been quoted elsewhere for around £1500.
We cannot afford to loose £4700.
Oh, brilliant. One of those fancy gearboxes that's wonderful until it goes horrifically wrong after about this length of time. Sorry I've nothing more helpful to add but I wish you the best of luck getting it sorted. :beer:0 -

true. The new law simply states if it is taxed, it has to be insured. You can even get 'lay up insurance' for classic cars that are being restored and won't be used on the road.

I can't send any link to my CSIS policy, as they don't mention tax or MOT in any policy t&c's. Axa have the phrase, You must:Comply with the following conditions to have the full protection of your policy. If you do not comply with them we may at our option cancel your policy or refuse to pay your claim or reduce the amount of any claim payment. You, all named drivers and anyone else seeking to make a claim under this policy must :12) make sure the car is taxed and roadworthy including that it has, if required, a valid MOT certificate and complies with the Road Traffic Acts (e.g. has legally correct tyres, lights, brakes, windows etc…) to drive in the country in which the claim occurred; which is normal, as they will pay out less for a car without a valid MOT, as it's not worth a much as one with the full 12 months, but they will pay out.0 -
This comes up regularly. The fact is that if you have no tax or MOT you may well be denied comprehensive cover, but if your insurance is paid up to date the insurance company is bound by law to cover Road Traffic Act (third party) claims.I used to think that good grammar is important, but now I know that good wine is importanter.0
