You have to go through CAB to report it.

Thanks Tilt. Its all be photocopied and sent off to DVLA with relevant letter today explaining circumstances and have included contacts from Trading Standards and CAB that have been advising us if they need any further info.

Quite apart from you getting your cash back, whether you "take it an further" or not, it sounds like enough different authorities are involved now for him to have a very uncomfortable time coming up. The IR can make life pretty unpleasant when people cheat them (unless you're some Banking Millionaire of course)
