    Ta Da!!

A handy book for people conducting Work Capability Assessments -

    https://www.gov.uk/government/publications/work-capability-assessment-handbook-for-healthcare-professionals

See Page 114 of the booklet (not the stupid picture that comes up in the corner as this says Page 116).

    It clearly states

'If the person needs to be shown how to do a task again, they have not learned it.

This activity may be relevant to conditions including learning disability and organic brain disorders including acquired brain injury or stroke.'

    Hope this helps.
  • EE I love you! You are awesome, thank you so much!!! I called today to ask for their reasoning and I was told that they would call me back within 3 hours, but as it was afternoon those 3 hours would spill into tomorrow. I will see what they have to say then, but I will swot up on your info before then and use it in the Mandatory reconsideration. Thanks again Xx

MiT, you are right about that one :rotfl:!

HAW, nice to have you back, I will hop over to your diary to see how things are with you.

This morning we went to the gym (DH had a bit of an angry strop there :() and then this afternoon we went to soft play with some Mums and little ones from nursery which was nice. Beavers tonight (last one for 3 weeks :j:j:j) and then a battle at bed time that lasted until about 20 minutes ago :(. DS2 has developed a nasty cough tonight but he'd had all the medicine he could have and he was demanding more. I realise he doesn't understand the dosage system, but he just wouldn't accept my explanation as to why I couldn't give him any more despite his begging. Totally draining. Hopefully he will be better in the morning as it is an open morning at his nursery and he's been looking forward to us going in to play with him. I've also told several of the Mums that they can come to me for coffee afterwards as I only live along the street from the school, and there will be around an hour to kill between the end of the open morning and the time to pick the children up. For some of the Mums who live in the next village and don't drive, it's not worth them going home in that time.

  • PS, this morning DH asked me where we keep the towels because he couldn't remember . I mean, really!! Then he put some breakfast out for DS1 which he said was 'the one he always has'. Except DS1 changed his cereal weeks ago and despite helping him put it out most mornings, DH had forgotten this. It's stuff like that which makes me think 'how would he manage at work?!'. It's not always major catastrophe stuff, just the little things that all add up. How do you fit that into a tick box??

  • Well I've had my phonecall. Apparently Atos 'don't believe DH's condition could have worsened since he was last assessed face to face when they found his cognitive function to be ok'.

    WHAT THE FLIP?!?!

The one and only time DH was assessed by Atos face to face was about 18 months to 2 years ago, before the seizures had even started and before we knew what day to day living/long term prognosis was going to be like after the accident. At that point DH's Consultants and Neuropsychiatrists were hopefull that he would return to a near normal state, but they have since told us that will NEVER happen. Atos mustn't have found him to be ok then anyway as they evaluated him as poorly enough to receive ESA. Last time his ESA was due for 'renewal' they didn't even need to see DH, they said the paperwork I had supplied was enough to prove his ongoing problems. How dare they say he can not have got worse!!

Mandatory Reconsideration requested which means someone completely different will review everything. They will then ring to discuss it with me before they make a decision, so I will be ready for them! At Mrs Hinge's suggestion I shall make notes from now until then of all the little things that crop up for DH in a day. I shall also be well versed in the support indicator information provided by the lovely EE. I can also ask for another face to face assessment by Atos if they still don't change their decision, and I can ask all his medical team to write specific letters as to how DH is in their view.

I'm ready for a fight!! Xx

Definitely involve your MP, and make it known that you have done so. Please be aware that the aim of Atos is to block as many claims as possible - they get bonused for it.
What would you get if all you got was what you were thankful for?
  • Thanks Satchmo, I shall bear that in mind, disgusting though it is!!

Ok, so run down of the rest of today.

DS2 said he was well enough for school, so off we trotted to open day at nursery. We had a fab time decorating cakes/eggs/Easter bonnets/cotton wool lambs/cards etc, but when it was time for us to leave DS2 started to cry that he was poorly and needed to come home. The teachers persuaded him to stay and we left, bringing 5 other Mums home with us for coffee. 15 minutes later the school rang and asked us to go collect DS2 who was extremely upset and coughing violently :(.

The Mums still stayed for the hour and to be honest it was lovely to have them. DS2 was all smiles when he got home, but he got steadily worse during the afternoon. He has developed a raspy gravelly voice as well as everything else, and has refused to eat anything. I managed to get him an appointment with the nurse practitioner late afternoon, but she said she thinks what he has is viral so didn't give him any antibiotics. I'm not convinced though and if he is no better or is worse tomorrow then I will take him to see a Dr.

DS1 had a parcel delivered today and he has won some Lego in a competition!! I think DS2 was more impressed though. I love free stuff :D.

Got weighed tonight and I've lost 3lbs :j.

I hope everything gets sorted soon with DWP - this is one hassle you really don't need on top of everything else. Why do they spend so much time chasing the genuine cases and let the !!!!!!!!!!s get away with it? Hope DS feels better soon. Well done on the weight loss!
