    This is a good little website where I have found this page which will be helpful - http://www.benefitsandwork.co.uk/employment-and-support-allowance/esa-glossary/1353-support-group-descriptors

    These are the descriptors Mr PLMBL would have to meet to go into Support Group. He just needs to meet one of them. Obviously you need some kind of evidence - I expect you have loads of medical letters anyway. I think a letter from you about caring for him (and what you do) as well would help

  • Thanks for that EE. I wrote the letter myself but I did have it looked at by someone within the job centre who thought it was on point. I basically listed all the support descriptors that related to Mr Lucky and gave evidence as to why. I included 2 of the most recent Epilepsy Consultant letters and one from the Neuropsychiatrist, all of which were detailed accounts of how they find Mr Lucky. I wrote the letter 'from me' as Mr Lucky isn't capable and explained all that within the letter, then we both signed it.

    I really thought I'd done enough, but I think they will be using the fact that it's not EVERY day, just most days. Also, for things like "cannot learn to complete a simple task like setting an alarm clock" it's very grey with Mr Lucky as most days he can learn the task, but then he will forget how to do it the next day and have to relearn it, which isn't covered by the descriptor. I will definitely ask for a Mandatory Reconsideration though, and thanks for the tip about following it up with a letter.

    Can't believe DWP would expect Mr Lucky to work! For a start who would employ him and what could he work as? Hope this gets sorted PDQ.

    I emailed MP earlier on in the week (re not hearing from the work programme people, though I did mention the fact that I still hadn't heard about the appeal yet) and I'm awaiting a response. I will let her know that it has been rejected and see if she can help.

    Your guess is as good as mine SA! When DH first had his accident I was happy to view him in terms of getting back to work at some point, so the Work Related Group seemed fair. He has got worse not better though, and I'm struggling to see him going back to work at all. Because he doesn't fit a box though, DWP feel differently and it's a case of 'computer says no'. As Mrs Hinge says, we aren't individuals when it comes to illness benefits.

  • Hope everyone has had a lovely Mummies Day!!

    I got some lovely cards, both homemade and shop bought and a bunch of shocking pink tulips which are very pretty. The weather here has been atrocious, murky damp fog all day (and it's set to be the same all week while the rest of the UK is hotter than Corfu sob :(), so the day out we had planned didn't happen. Instead we all went to the cinema, MIL included, to see Rio 2 :D.

    It sounds like you did the right thing in the letter.

    I will try to find you the official ESA definition of learn - I am 100% sure it is not that you can remember it that day, 'to learn' will probably be that you can complete the same task the next day and the one after that.

    The problem is the descriptors don't really explain what they mean, there is where previous Tribunal cases comes in as these set out the legal side of it.
