I'm having to 'unlurk' here!
With regards to the support group, if you search for 'regulations 29 and 35' you will find that of use, on Theblacktriangle website you will find template letters for his doctor to sign. It basically is a special regulation if there is a substantial risk to go straight into support.

My thoughts exactly! You go fight your case lucky! And I know you'll be well prepared. Do involve your MP too.
Woohoo! Well done on the weight loss!! :T:TWealth is what you're left with when all your money runs out0 -
Thank you so much once again everyone, I don't know what I'd do without you all!!
HaloBlue, you are a star! Thank you so much for delurking with that info! All these things I didn't know, just shows how we are treated like mushrooms (kept in the dark and fed shizzle!). Please stay out of the cupboard, we don't bite!!
Had an awful night last night, first with DH who was snoring and very jerky and then with DS2 who joined us in bed at 4.30am and added his own snoring/coughing combo to the mix. Took him back to the Drs this morning (who were already running an hour last by 9.30am ) and he has viral tonsillitis. He has 'grade 2 tonsils' which means red/sore/inflamed but no pus and he has been given a mouth spray to have on top of the usual calpol etc.
This afternoon I called F1rst Utility, as not only have they not replied to my complaint, but they also have not claimed my direct debit this month either so I wanted to know why. Apparently I brought my account up to zero when I paid the amount they said I owed from January and I didn't actually owe it to them when I paid it!! Confused? I am!! Anyway, waiting for a Manager callback within 48 hours as they have no record of my complaint!! This is despite me sending a letter, submitting 2 online complaint forms, and being told on the 10th March that they had my complaint but hadn't looked at it yet!
Hopefully I will have the extra direct debit money to play with this month if the Manager confirms that I really don't owe it. I could do with a bit more in the pot for the 2 weeks that the boys are off over Easter, and if I pay a bit off B/card then I'll be inching closer to having it cleared before the 0% runs out in July.
Absolutely shattered! Is it bed time yet?! XxDebts @ LBM £23,729.31. Debts @ 08/04/2016 £0 :j

Hi Lucky, :hello:
Just catching up..
Must admit to shedding a tear or two while reading your description of post-accident life with DH. Could be useful to base your statement on for the appeal process..
The incompetence of @TOS is becoming legendary.
..............
Hmm well I just spent two hours reading all sorts of stuff - have you come across Black Triangle?
One thing is clear: As the @TOS personnel get sanctioned for putting more than 20% of applicants into the support group, how can one find out when their counting period starts? Eg., if it's monthly, then there is an obvious advantage in getting an appointment during the first few days of the month. If it's weekly, Monday would be the day to aim for...
 Anyone know?
Jeez. Time your MP earned their inflated salary, Lucky - hope you've got a feisty one!
Sorry can't comment further - must take dog for a walk before m' head explodes.
Lucky, you deserve a standing ovation for tackling it all!

Regulation 29 gets people straight into Work Related Activity Group without meeting any descriptors.
Regulation 35 gets people straight into Support Group.
I would mention the descriptors he meets and at the end say something along the lines of ' If you dont agree please consider Regulation 35' and then explain why there is a danger to Mr PLMBL and/or other people if he was found fit to work and fit to undertake work related activity.0 -
Robin I've only just discovered black triangle thanks to HaloBlue's information. Like you, I've been lost in a wealth of information since I read about it on here and there are some very useful tools around to help. I'm sorry to have upset you with my post accident life traumas of the other day. I don't feel like that all the time, but since writing my list of issues that crop up during the day, I can see how I get tired and down. For example, in a small window yesterday the following happened
1) When I asked DH to put the cutlery on the table for dinner, he asked where everyone sits to eat as he couldn't remember who sits where.
2) DH tried to answer the home phone but cut the other person off as he couldn't remember how to operate it and he pressed the wrong button.
3)He asked me the same question 3 times in the space of 40 minutes.
4) He had an angry strop because he misread me trying to have a have a joke and he threw the glass jar of mustard into the fridge. How it didn't break I don't know!
5) He took things out of the cupboard whilst looking for the peppercorns to refill the mill, and then left everything on the bench and walked away. I left them there on purpose to see if he noticed and then later he asked why there were things on the bench. He didn't know he'd got them out in the first place and couldn't remember doing it
See, none of this is major but it's constant. It's not so bad at home when I can mop up the damage so to speak, but I don't know how that would fit into a workplace environment. I can't see an employer keeping him on as I think overall he'd do more wrong than right. I can also see how I think it's been a good day when we get to the end of it with no seizures or major dramas, yet it's still not actually been a good day in terms of 'normal'.
EE thank you once again.Debts @ LBM £23,729.31. Debts @ 08/04/2016 £0 :j

good luck with finding the proof lucky.
My mum had an anerysim, 37 years ago. she can only walk short distances and has not been able to speak.
She has only just got a disabled badge as she has just met criteria.
Also for info @tos are relinquishing the contract with DoH but I think the criteria are set by DoH themselves and not @tos. So whoever steps in will have the same stringent and inflexible rules.Trying to shift that debt!0 -
Sorry to hear about your Mum SBO, aneurisms are so cruel. My friend's Mum had one about 4 years ago and it left her paralysed from the neck down and with similar brain injury problems to Mr Lucky
. She's been in a care home since it happened and she's only 50.
Well I'm awake at stupid o'clock thanks to catching DS2's lurgy. My nose is streaming, my throat is sore, eyes are watering, chesty cough and I can't sleep because of it. DH is snoring like a warthog which isn't helping either!! DS1 was complaining of being ill when he went to bed too so I'm not holding out much hope of him being in school for his last day of term tomorrow (today!!). Nursery have finished now for Easter, although DS2 missed his last day with being poorly. He did however win his class' decorate an egg competition in his absence (they did them on Tuesday before he was sent home) and they sent his chocolate Easter egg prize home via DS1.
Have checked the banking and have been paid by Mr A's. As it includes holiday pay, I've been paid £35 more than usual :T. Seems it's more profitable to stay at home!! I will pay the difference off Bcard I think. I need it gone by July when the 0% runs out.
Going to try and get some more sleep now.....Debts @ LBM £23,729.31. Debts @ 08/04/2016 £0 :j

Thanks Rach. Finally went to sleep about 4am, feel yuck today. I had promised DH a trip for new shoes today as his have got cracks across the bottom and are letting in water. Trying to pull myself together enough to go.
DS1 is doing the whole dying swan routine. Why doesn't he realise that his overacting just makes me think he's well enough for school?!Debts @ LBM £23,729.31. Debts @ 08/04/2016 £0 :j
