<snip> We must however reiterate that motorists should always check the ticket as no machinery is reliable at all times." <snip>

OK. That's fair enough, I suppose.

But, if you pay £3.50, and get a ticket for only £3.45, what would they expect you do?

The main point being of course is that they are admitting to the possibility that it is their machine at fault. :D

Why don't y'all pay attention? We keep telling you, these people are NOT BRIGHT
  • OK think I'm gonna send them 5p. Heres a draft of the letter. What do you think ?

With regard to your PARKING CHARGE NOTICE please find enclosed 5p in full and final payment of any money which you may believe you are owed. (although as you admit in your previous letter it may well have been your machine which is at fault, I quote "no machinery is reliable at all times"). I trust this will conclude the matter, however should any further demands for money be received from you please be aware that legal action may be taken resulting in court proceedings being issued.

Or, to get across essential points?

With regard to your PARKING CHARGE NOTICE No. xxxxxxx please find enclosed 5p in full and final payment of any money which you may believe you are owed. This payment is made without admission of liability, since I believe that your ticket machine was at fault and I note that you admit in your previous letter it may well have been your machine which was at fault; I quote, "no machinery is reliable at all times". However in view of the amount involved I do not believe that it is worth arguing over this issue at this time. I trust this will conclude the matter, however please take notice, that should any further demands for money be received from you, I will consider them to be unlawful harassment, and legal action will be taken resulting in court proceedings being issued against you.
  • Thanks FA. I'm gonna stick a 5p coin to the letter rather than send a cheque, then unless they send it back to me they will be deemed to have accepted my payment. :D

I have to advise that a cheque is better. You can write on the back of it "In full and final settlement of all liability to the Payee".

They won't cash it, but its been offered as a document. Make 100% sure it cannot be altered though... oh, on second thoughts maybe just give them cash.

So what made you change your mind ? Also I was just wondering if there is a limit to how small an amout you can write a cheque for.

    One penny.

I would recommend a cheque. It gives you evidence of payment, ie. the cheque stub. It also gives them the option of accepting it as "full and final settlement" or not, and there being proof of this, ie. your bank account.
