    They may not have to freeze interest but if you write to them and say that courts would frown on them for not freezing interest and helping you to pay them back they normally back down.

    Here for example is a letter I wrote with the help of a template off National Debt Helpline and it worked!

    "Thank for your letter dated . I am very disappointed that we seem unable to reach a satisfactory compromise on this case. As we have already explained, we can only afford £ per month at the present time. This is the only realistic payment proposal bearing in mind the enclosed personal budget sheet.

    You have stated in correspondence your intention to commence proceedings in the county court against us. The commencement of legal proceedings under such circumstances could be count to ‘Overriding Objectives’ of the new Civil Procedure Rules. You will be aware that the Overriding Objectives underpin everything the court does. Moreover, paragraph 4 of the Protocols Practise Direction states that in cases not covered by an approved pre-action protocol, the court will expect the parties “to act reasonably …… in trying to avoid the necessity for the start of proceedings”.

    I would suggest that your refusal to accept our offer could be viewed as unreasonable and I would ask the court to consider this matter with reference to the Overriding Objectives.

    The offer of £ is of course still open to you to accept.

    I would be grateful if you would send a paying-in book or standing order form to make it
    easier to pay."

    Just a thank you for all the warm welcomes you have given me. teecee152, yellowmonkey, smilealot, hunteress, Ilovegreatdanes, newleywed and anyone else I have missed out. Much appreciated.

    To itsdrivingmemad I would say contact the bank yourself. Re the e-mail sent via justabank I didn't get a reply from one of those so I wonder if they miss them occasionally. Apart from that Payplan have been very good so far.

    Sorry I haven't responded to the welcomes earlier but have had a better day today. No ph calls. :) Look forward to seeing more posts and will ask for help if needed. Thanks. XXX
  • Hi and welcome to the newbies. HSBC are on the prowl again and phoning constantly again, 1 every hour this afternoon/evening - sometimes 0800 and sometimes unavail (mean abroad!) and sometime 087 - why will they not just accept I am trying and intend to repay all I owe - including interest on the pl and useless ppi, their cc have accepted so why can't the bank - they are really doing my head in!!! Also if they got their finger out and repaid all my charges our debts to them would be reduced by over £2,000 immediately. sorry for the rant but they're doing my head in!! Sorry not able to offer any advice/support to anyone tonight I'm drained - full day at uni today (4 weeks till my first exam), then college tonight for maths and work again tomorrow - the s*** from HSBC and its raining (although on a positive note I re-seeded the grass at the weekend and the rain/sun will do it the world of good).

    Morning all. Got my online password for CCCS ;)

    Also got a letter from First Direct saying they accept the repayment proposal from CCCS!!! :D

    Only thing is they want to "amalgamate" my visa balance into my overdraft so there is one to keep track of and to reduce interest and want to send me a new Agreement detailing payments and interest charges - anyone here think this means they want to try and get me to do a managed loan????

    Surely they can't have agreed THAT easily?? :confused:

    Tell me If Im understanding this wrong but if they have excepted your Dmp payments then there would be no interest, would there?????????

    I would contact CCCs and see what they say.

    Well they are allowed to accept and still charge interest - there's no legal obligation for them to stop interest is there?

    At least they said they want to amalgamate them to "reduce" interest. At this precise moment in time even 2% reduction would be something!!! :rotfl: Some of the cards have recently been put up to 24% APR!!!! :mad:

    Have emailed CCCS and will wait to see what they say. ;)

    GE Money say reduced payments are not accepted as there was recent activity on the account (erm well over a month ago I bought some FOOD!!!) :rolleyes:

  • Payplan want me to contribute any lump sums I get to the plan and share then among my creditors. I think it's best to pay off the key ones (e.g. the credit cards) with the highest interest and get rid of them, so simplify matters.

    What do you lot think?

    I think others have said that if you pay one off then the others get annoyed that you had extra money and didn't pay it fairly across them all. I think they recommend distributing it to make sure the creditors are all being dealt with fairly (as they are more likely to be happy this way).

    newlywed, thanks for that did not know. CCCs are very good at answering emails have emailed them a few times and always get a promt response.
