They can not present anonymous evidence in court, someone would have to make a statement of fact surrounding the filming and that person can be put on the stand and questioned, which is the best thing for them.Hi, we’ve had to remove your signature. Yes and interview team must never comment on any payments due and if they have I would make a formal complaint because they have broken the rules of their role.
Assumably when they remarked on his work sick record you reminded them that DLA is not an out of work benefit and asked them why they were altering the legislated criteria for the purpose of the interview?0 -
The solicitor did remind them that DLA is payable while someone works and that being disabled does not mean you have to be on the sick.0

Were you allowed to go into the IUC even though your son is 31 and he had a solicitor? It doesn't sound that he has MH issues, so why did you attend?0

I don't think much of the interview team if they don't know the eligibility of the benefit they are interviewing about.
I would have asked if they were even competent to conduct the interview and ensured that got stuffed up their tape recorder.0 -
Well good luck anyway. The way I understand it is they have mentioned him not being in pain as a factor to his mobility, while he must have put he is in pain when walking to for his motability award.
If he is on LRM (lower rate) I can't see an issue, however if he is on high rate motability, not in pain when walking and not using any aid ( as most people do) then it may be different, although I would be very surprised if they awarded someone HRM who states they can walk without ANY aid but at the same time states they are in pain.

I did not go in to the interview with him I waited in the waiting room but, I could have gone in even though he had a solicitor with him. They did ask him if he wanted me to go in but we already discussed this beforehand and felt that as he had the solicitor with him and the fact that I would not allowed to say anything during the interview it would be better for me to wait outside. When he came out with the solicitor we discussed everything that had been said and the solicitor said to let him know as soon as we hear anything.0 -
I am absolutely flabbergasted. This is outrageous. I don't know what to say. I am so glad you have a solicitor, I hope they can sort this all out. Your son obviously works hard to to have a job with a disability, and to make sure he gets there everyday. And he's being penalised for this??0

I agree. I can't stand benefit fraudsters, but nothing on this threads seems to suggest anything other than a genuinely deserving case with the support of his family, GP, and manager, and who is doing everything to maintain as normal a life as he can and is rightly entitled to his benefits.
I can't really comment on whoever tapped him up to the DWP - but they should be ashamed of themselves. If it were me then (1) I wouldn't "grass" on anyone based on my opinions of or feelings about a person and (2) If I DID have a genuine reason for reporting someone I would be happy for it to be openly acknowledged that I did it. I wouldn't rat-out anyone with something that I wouldn't say to them face-to-face.
It must be a deeply upsetting situation for you, OP, and for your son. I hope that all will turn out OK in the end. x0
