CB will do one of two things, they will... keep paying the original claimant for 3 weeks after they get your claim or they will pay her for 56 days after the child left home.
The CSA insisted that they had to charge me child support between the date the child came to live with me until the child benefit actually switched over which because I did not claim straight away (had not anticipated a dispute) turned into 10 weeks. This is complete nonsense as my successful appeal proved.
Mum is entitled to claim for 56 days after the child leaves home but that does not automatically entitle her to child support. I wouldn't waste your time on child benefit claims just to negate hers, its just another way for the SA to tie you up in knots......just stop paying child support and advise the CSA of the situation.0 -
His Wife, I sympathise, we have a similar situation. The person that said it's about the child was absolutely right, and I feel that the PWC has ruined the child's prospects by pushing her non-academic child to take on A levels instead of taking a more suitable vocational course or even encouraging the child to try and get a job all because she wanted to keep her CSA payments.
The child has dropped out of the A level course that started in Sept because it was too hard - we knew it wouldn't last until Xmas because the child in question is not academic. What on earth the school were thinking giving her a place in the first place I'll never know - a child with only 5 GCSE's at just scraped by grades taking 4 A levels - how ridiculous, and what about that child's self esteem when they have to admit to failure - who is thinking of the child then? The mother is thinking of her CSA payments, and the school their funding!
That is not a mother putting her child first, and doing the best for her child. The child could have been working from when the GCSE results came out and earning some money and self respect, or doing a course that was suitable that started in Sept but instead now has been doing nothing since December, and is hoping to start on some sort of apprenticeship - hence CB still being paid. An apprenticeship that pays about £2.50 an hour which will no doubt have some academic elements, and I can see that the child won't complete that either and it will just be a waste of time until becoming 18 and able to claim benefits. The mother won't encourage the child to go and earn £4 or £5 an hour working in a shop or similar job because she'll lose her CB and therefore CSA payments, which in total come to more than £300 a month. Not every child can be academic, and lets face it the world needs people to work in shops and suchlike or we couldn't all live!! By now the child could have some savings, some money to do nice things and buy nice things and even pay the PWC some keep, but instead has wasted 7 months of possible earnings, and is sat around letting life pass by and complaining that for a child under 18 still living at home there is no provision for any benefits to be paid other than CB.
We have tried to talk to the child ourselves and impress upon them that if we no longer pay CSA then we would continue to support the child directly financially, but that doesn't mean we wouldn't expect the child to try and find a job, but not surprisingly because of her greed and avarice the PWC's influence is stronger and she continues to keep the child on the path of apprenticeships from which no jobs are forthcoming. Meanwhile we continue to pay the PWC a considerable amount so that she can encourage her child sit around learning nothing and earning nothing - what a great start to life!!0 -

My step child is now living with us, for how long, who knows, it could be a month, a year, i am not sure, but has a roof here, until she no longer needs or wants us. The problem were having at the minute, is we need to accommodate her, yet we dont have the funds to do so, as we are still paying her mum for a childs upkeep, who we are upkeeping!!!! madness or what.
13kent, like you my step child only went to college as her mum promised her it was in her interest, nothing at all to do with the 1100 a month income that is generated by her being in college!!
Since being kicked out of the family home, her mum hasnt contacted her once, its breaking my heart, knowing that it wasnt the love of a child, rather a love of an income that fueled her for all these years!
Hopefully, csa, or cb will come to their senses shortly, and help us, other wise we all going to be living on beans on toast
On the other side of the coin, i am a pwc, and receive a pittance of my ex, always inform csa, cb of any changes, yet i am deemed as the baddy. Never mind, one day we shall all live happily ever after, when the csa is no longer required.0 -
my step daughter has now signed on, due to fact we cant give her any money as we are already giving it to her mum!! we can not physically pay twice, i can feed, her and give her a bed, but can not give her money we really do not have.
We informed csa, they have told us , we still have to pay as her mum hasnt informed them, nor have they been able to contact her!!! so until she confirms this, we still have to pay.
Tried speaking to child benefit, and they said , as we arent the parent with care they cant speak to us.
Can anyone please advice me on what we do next.:wall:0 -

Call them again and ask to speak to a supervisor - point out that the QC is now In receipt of a prescribed benefit and as such is now no longer classed as a child.0 -
have called them again prelude, they must just have a hymn sheet and keep singing from it!! all they keep saying is, they need to confirm details with parent who no longer has care!!! She is not replying to letters, nor answering calls.
Told them to check cb etc, as well as dss, yet they still saying the have to go through protocol, of contacting pwc!

Is the qc definitely claiming a benefit that is now in payment? If so, call them again and tell them to check Opstrat or CIS, these are two systems that they use to check circumstances - if the 'child' is receiving JSA or income support then they won't be classed as a child any more.0 -

nicky3, i beleive we pay in arrears for csa, so we said we would pay march payment, even though she has been out of college since beginning of feb? possibly last week in jan. We owe enough money out , without, getting arrears for csa:o0 -
What a ridiculous and frustrating situation, the "pwc" is still getting child benefit and CSA for a child that no longer lives with her and CB and CSA won't cancel payments until they've talked with the "pwc"? What happens if she refuses to answer the phone or letters from them, will she continue to be paid? And I thought all these agencies shared information, surely they can see that if the girl is claiming JSA in her own right she's no longer a dependant?
I can understand that they can't just stop benefits on someone else's say so otherwise that could be abused by bitter exes etc but surely if the mother is refusing to answer calls and letters they would do some investigation?
I wonder if the "pwc" will be committing fraud, claiming for a child she no longer has care of?Dum Spiro Spero0
