more csa woes

I have wrote on here before about my step daughter, today i have found out, that she got kicked out of college 7 wks ago, for only having 30 per cent attendance. there is no way of her being let back in this year.

She has an interview next wk for getting back on next years course. My question is, can we inform child benefit, or does it have to be the resident parent, do we need to inform csa also.

Thanks in advance

you pay for that whole term even if she was kicked out...even if she only did 1 day you have to pay for the whole school term...you know how fair the csa is...

Notify them anyway, and contact the school to see what proof they can give you, even if it is kicked out but readmitted next year, that means the term ends in 2 weeks and nothing to pay until september as that would be when CB is payable again if under 19..

its wrong that u pay for the whole term, but the csa is a law unto itself isnt it??.

Thank you guys, problem is now, trying to convince csa, that they need to speak to child benefit, since child benefit wont listen to us,, and csa have called the pwc who has said child is in college, when she blatantly isnt!!!!!

Roll on her 19th birthday thats all i can say:D

As i said, if you can get proof from the college, then the CSA will have to take that as right, they may well inform CB for a fraudulent claim, but you could do that as well.

It is wrong, and i would raise a complaint in writing as soon as you have the proof from the college. If they say she is an adult (which they might) and they can't inform you, then be polite and ask them if they could inform the CSA she is an adult as current legislation implies that she is a child and subject to "child support" if she is in full time education which she is not. ;)

We're in same situation, trying to prove QC dropped out of college a month ago.
As far as I can tell, unless QC signs on at Connexions CB is not payable after certain dates, Feb 28th being first May 31st being second.
If they do sign on at Connexions PWC can apply for 20wk extension to CB.
We know our QC has not signed on at Connexions and CB is still being claimed.....difficult situation.

I don't think the CSA can really be blamed here - when both parties disagree the CSA will look at other evidence available, here the evidence is whether child benefit is in payment or not. CSA have checked, and it is in payment, so they will class the child as a child still.

So what is the situation if the college confirm she had been kicked out...? Will they do anything then...???

It is a very biased unfair system to purely rely on CB being paid, which we all know is open to abuse...!

Exactly, I think the colleges etc., should be contacted to confirm either way..........surely its benefit fraud if the QC is no longer attending and no longer fitting the requirements for CB to be legally claimed??

No i don't think it is, i think it is the legislation that gives the power to the CSA that they just keep taking taking taking.

The CSA should NOT be reliant on simply one benefit that it paid without checking. And common sense says if a letter from a school or college states that the child no longer attends then payments should cease regardless of CB fraud. ;)
