latest stage of developments, step child has now moved in with me, so we now have even less money than ever! but at least she knows she is here out of love, rather than how much money she can generate.
We are still paying child support to his ex, as she is still receiving child benefit:mad:
But, she is safe, and wanted. I suppose we can all live on soup and love0 -
Can you not just stop paying??? id be tempted to try claiming CB for her, then when they question it, state she is with you. At least she can get her head straight now, away from her mum. She may even realize she has been used as a cash cow!! Also id be inclined to inform any other relevent parties (Council re HB etc) that the "mum" no longer has the child there. xxxxxxxx

Definitely put in an immediate claim for CB, and phone the CSA to notify them of a change of circumstances, but follow it up with a letter sent recorded delivery.
If you are on a DEO then you will not be able to stop that, but if you are paying through SO or DD then cancel it immediately...!
Any over payment from when you notify them will be paid back, some time this century, and i know that doesn't help, but there is always the option of going and claiming a social loan from the benefits agency...I know that you will probably get turned down, but it will be in writing, and will add weight to your complaint against the CSA at a later date. IF YOU APPLY FOR THE LOAN, GIVE THE REASON FOR WHAT IT IS, CSA deduction leaves you with no money for food for the child CSA deducted for living with you.

we cant claim child benefit for her, as she got kicked out of college approx 6 wks ago. So i wouldnt think we would be entitled.
We are not on a deo kevin, but the csa to take it via standing order. If we cancel would they not then go for a deo?
Ah overpayments, we will possibly get it back, maybe , eventually. As long as his ex doesnt mind accepting money for nothing, then she can have it, we always knew it was never for his daughter.

I understand the CB, BUT make an application anyway, with a request fro NO payment. That will at least stop her claiming it and the CSA chasing you.
They could well go for a DEO. but wouldn't they just look stupid if they did...There are certain things you can appeal and attend court for regarding a DEO, and i would certainly attend with regards to this, just to make them look stupid, especially if you stood in front of the magistrate and said we don't understand why they are doing this, there are no arrears and the child lives with us and has done since so and so... I think the magistrate would rip then a new a**e...

Read what i wrote, put in an application, and as soon as it is accepted cancel the claim...!
This removes any confusion with the CSA as to who has custody...

It is there legislation that makes people go to extraordinary lengths because they are so crap at what they do.
And as there would be no money actually claimed it cannot be fraudulent, and lets face it, even if there was, do you actually know anyone that has been prosecuted for such a thing...? If so, please do tell, cos the CSA don't seem to care, as long as there figures improve...0 -

kevin didnt say fraudelent claim, he said counter claim to cancel the cb out. have spoken to csa and they are going to leave the case on hold, as cb is still being paid, so we are going to claim cb, just to cancel the other claim, we will not, be receiving any money.0 -
