Ive read all your very helpful comments but unfortunately not until after i had sent securat a stinking email! has this ruined my chances of just ignoring them?

No. You can still ignore them. Like they will have ignored your e-mail. They won't be writing back apologising and cancelling the ticket.

Your email doesn't suddenly make their contract breach charge enforceable. They are still legally only entitled to actual losses suffered, which is still zero, email or not.

OK, new orders: send them a stinking e mail and then ignore them. Just don't tell them your address, (or admit being the driver) then they can waste £2.50 getting your details from DVLA. Which won't help them if you give them the cold shoulder from then on.

in less than 24 hours i got this response:

    17thApril 2012

    Vehicle Registration:

    Reference No: 0000901403

    Dear Mr

I am writing inreply to your email dated 16thApril 2012 which relates to the vehicle registration

    above.

On the 10thApril2012 at 15:30pm yourvehicle was sighted parked in contravention of the warning signs displayed at location WESTBURY EN8 9BO that Securak is contracted to enforce parking restrictions upon. You as the driver are responsible for theparking/waiting of the vehicle and were photographed and the details of yourvehicle were recorded for parking out of a bay and for obstructive parking. Thearea in which you parked is strictly for the business parks permit holders andauthorised vehicles only.At15:35pm aPCN(ParkingChargeNotice)wasissuedtoyourvehicle.

We understand that people have their ownvalid reasons for driving and parking on land that Securak is contracted topatrol restrictions upon. But the fact of the matteris that at the time the

PCNwas issuedyou were trespassing on private land without authorisation and therefore werein contravention of the clearly displayed warning signs. You state that youhave made a complaint to the police and will also be makinga complaint to the local council but this is a civil dispute which is

not a policematter and is on private land which is not a matter for the council.

So after viewing the photographic evidence andreading the report from the operative we regret to inform you that your appealhas not been upheld and that the parking charge notice still applies. You have14 days to pay the reduced fee of £75 from the date of this letter, afterthis period the fee will raise to £100 if paidwithin 28 days. Failure to provide payment of the full amountwithin 28 days will result in the charge increasing to £150 plus court courts.

PLEASENOTE: We photograph and documentevery vehicle that we issue a peN to; in order for us to provide to court asevidence against you should we need to rely on it at a later date.

    Yours Sincerely

Sound to me like they're admitting the amount they're trying to grab is a penalty rather than a reasonable pre-estimate of losses incurred which would possibly mean they've shot themselves in the foot.

You should print off a copy of their e-mail in order to provide to court as evidence against them should you need to rely on it at a later date.

I'd ask for a properly punctuated one. What is a "policematter" or "documentevery"? :)
