My Right PS3

Hi All,

My wife bought me a PS3 in sept 2009, i also purchased a extended warranty for 2 years at a cost of £30. it states on my certificate that it starts on 04/09/09 and expires on 03/09/11.

Just this morning my ps3 would not switch on properly, (it doesnt look like the YLOD (Yellow Light Of Death)). I have called sony and the have logged my complaint but are only willing to look at repairing it for £110 which i said was to expensive as per the price of the original product. Basicly they said tough.

I explained my situation further, saying it has been well look after and i did purchase an extended warantty, they have told me to go back to Game (where it was purchased) as they should not have charged me for the first 12 months of the warantty as this is standard manufactuing guarantee.

I still have all receipts, credit card bill and box that it can with, I mentioned "sale of goods" act and "fit for purpose" not knowing much about them but beleive that the console should have lasted longer that 30 months.

I havent been to game yet, but will be going to see them this week.

Any all help is grateful.

    Sony are right when they say your problem is not their responsibility.

    Go back to the retailer, but be quick as Game seem to be in some sort of trouble.

    Are you sure the warranty you purchased didn't say something like "extend your warranty to two years for £xx"?
    I.e. not charging for two years, but charging for extending it to two years.

    You are spot on Wealdroam.

    The 2 years cover is actually 1 year included as standard and a second year that is paid for, so the 2 years begins from the date of purchase.
    * 1 year of breakdown cover is provided with the purchase of your console. GAMEcare includes 1 further year of breakdown cover and accidental damage cover from the date you purchased your console.

    1. An Insurance policy with Allianz Insurance plc which protects your product against accidental damage from the day you purchase your product. Allianz will pay the repair costs if your product fails to operate as the result of an accident. The repair costs are limited to the current replacement cost of the product or the original price you paid, whichever is the lower amount. This policy starts on the date you bought your product, as shown on your purchase receipt, and provides cover for 2 years from that date.
    2. A Service contract with Three Pillars Business Solutions Limited (TPBS) which protects your product against mechanical and electrical breakdown after your manufacturer warranty has expired. TPBS will pay the repair costs if your product fails to operate as the result of mechanical or electrical breakdown. The repair costs are limited to the current replacement cost of the product or the original price you paid, whichever is the lower amount. This contract starts upon the expiry of your manufacturer warranty, or the GAME warranty provided on pre-owned products, and provides protection for 1 year from that date. This contract is subject to the relevant service charge being paid, and to the terms and conditions shown below. Allianz Insurance plc and Three Pillars Business Solutions Limited (TPBS) are part of the Allianz (UK) Group Companies.

    So you get accidental damage cover for the full 2 years and extra breakdown cover for the 2nd year

    None of this stops you from trying to get a repair or partial refund under your statutory rights, but this may prove difficult as you will probably need to prove that the fault was due to a manufacturing defect and not caused by misuse.

    I just checked the paperwork properly after coming home from work and it is exactually as you have stated, "years accidental damage, 1 year extra break doiwn starting a year after i bought it.

    I am still hopefull to bring it to game this week and point out that the console is perfect, not a scratch, i still have all receipts (till receipts, credit card receipts, insurance certificates and also the box with all wrapping from inside) this may show them that i have looked after my console. I also have a ps2 in the same condition and older consoles (i know im a bit odd).

    My further question is should i go into the gentle, or should i be quite firm, or should i go straight to the head office. if anyone has ever worked for game or has had the same problem please let me know of your outcome

    Well considering that the burden of proof is on you to prove that the goods to not conform to contract, I'd say gently.

    Going in guns blazing will probably just wind the retailer up in any circumstance, and may even diminish any chances of goodwill they may have.

    Bear in mind that, even if you do manage to get a refund, it can be reduced to take into account any use you have had out of it. At 30 months, this would take out a sizable chunk.

    Ex Gamestation employee here. (worked for them both before and after the GAME group buyout)
    OK, basically, GAME head orifice are usually quite crap, and with all the trouble they're in at the mo, will probably not be too helpful.
    I'd go into your local GAME (quickly!) and try the gentle, friendly approach. One thing that used to wind the managers up more than anything was people forcefully quoting their (often misunderstood) consumer rights. They were much more likely to go above and beyond for friendly people who asked politely as opposed to going in all guns blazing.
    If you fail to get anywhere with them, then try the SOGA route. Go in armed with a hard copy of the act, relevant points highlighted). Bear in mind that GAME don't do repairs, so it'll be exchange or partial refund, and I've not known them ever do a partial refund either, so you can probably expect a straight swap for a pre-owned console.

  • Thank you all for the help ful advise and comments. I am planning on going to game tomorrow evening after work and see what they say. I just hope that i get a manager in a good mood and he helps me out.

    Thanks unholyangel, yea i did pay for it by credit card, i have also managed to find the credit card receipt so i dont think i will let this on lie, i normally just say "its one of those things" then go and buy a new one but this has !!!!ed me off a bit. I also have learnt alot this week getting advise from people.

    Thanks mattyprice4004 i did say to sony that i would expect the PS3 to last longer than it did and they were very helpful in giving advice and telling me to go back to game, i realise that sale of goods act does not apply to them as i purchased it from game.

    I shall let everyone know what happens tomorrow.
