    Ahh i see, i thought the court had agreed to set this aside already - many thanks.

    just one more thing ,I assume becasue of the current test case this will not proceed any further until the outcome - should I need to, how do I go about opposing this (seems a bit too easy for them to claim admin error, they could do this for everything, I bet it wouldn't wash if it was us saying 'oh sorry, had an admin error, didn't mean to go overdrawn' ) - sorry to pick your brains again and thanks for all the help so far.

    Actually if they fail to get the judgment set aside the OFT case becomes irrelevant in this case as you can enforce the judgment regardless of the OFT case.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

  • I am claiming overlimit and late payment fees from a store card RBS ran called STYLE

    thing is, the intrest they charged me each month varied on the account depending on what balance i had. Can i reclaim that also or is it simply Over limit and late payment fees only from cards?

    Im sure it is but i cant find the article i read it at now so just want to check before i post my letter.

    Can anyone tell me if they have received payouts on complaints re charges post test case with RBS. I had a final claim stalled at the last minute as only 6 weeks had passed when test case was announced.I'd had success with the 2 previous.
    I've just sent of a letter to the CRU and the CEO by fax threatening to close accts should they not deal with my original complaint as I feel as a customer regardless of the complaint it should be dealt with using their discretion. Will let you know what happens. Might aswell try as nothing to lose and I have a parachute acct anyway. All depends on how much they value customers at the end of the day?!
  • Can someone advise me, I'm with RBS. A couple of weeks ago i went four pounds overdrawn (twenty eight pounds charge). Also last week i went six pounds overdrawn (another twenty eight pound charge). I did speak to the manager of my bank. There's nothing she will do. I could go on that i'm on unpaid maternity , hardship etc. It falls on deaf ears. I do feel the information on digtal banking and the cashpoint can be misleading. Me going overdrawn happened on a Friday but didn't show online till the Monday, by then its to late to sort out.. Am i being unreasonable? its my fault for not keeping my account in order... I'm waiting to hear from HSBC about opening an account there..do i give up on re claiming these charges?

    If this was the first time charges have been applied, I'm a little suprised the bank didn't consider refunding them. If they definitely won't budge, you will need to write a letter. Please see the article in my signature and this update:

  • In Aug 07 an unauthorised DD went out of my account, i incurred instant thirty eight pound charge plus a twenty eight pound charge for going overdrawn (due to the instant charge). The thirty eight pounds I got back from the company who attempted DD (PHEW). Then every month i got charged for the charges making me go overdrawn. This was resolved finally a few weeks ago after many phonecalls, letters and emails. They even sent me a hamper for all the stress they caused.

    So i think now this has happened, they're not going to let me off these new charges.. I've spoken to the manager she just told me to watch my account more carefully (which I do check it on a daily basis) I've emailed a compliant, they told me to speak to the manager.:confused:
  • Made a last ditch attempt and emailed the bank again to complain about the charges I incurred for going overdrawn by six pounds one week then by four pounds the following week. Charges totaling 56pounds!! Had an email back from a lady telling me the terms and conditions (the usual brush off). So i replied that I am experiencing hardship and explained my financial situation in slightly more detail, on unpaid maternity etc. I didn't ask for a refund I just wanted to voice my opinion on how unfair these charges are for people in my situation who are trying to keep our heads above water, I know these charges aren't fare for anyone but when a 28pound charge is more than a third of a weekly budget (family of five to feed). Anyway the email landed on sympathetic ears, and my account is going to be credited 56pounds as a gesture of goodwill!! which I'm delighted about. :T MERRY CHRISTMAS!!
  • That's great, but maybe you should write down every transaction you make, count it as being spent, meaning out of your bank, then it may not happen again, as banks will be worse over xmas period, for showing A TRUE balance......;)
