I've been offered an amount from RBS that I'm considering accepting but what I'm looking for is a link to a response letter I can adapt to send back basically accepting the offer at this stage but with the option of still being able to claim back the full amount if the test cases over unfair charges go in favour of us, the customers of the banks. Any suggestions would be appreciated.0

Hi.
Frustrating I know.I set about dealing with these charges in February. Natwest paid up on all accounts once the final letter was sent advising of the instructions for court proceedings.
Barclays tried to fob us off with an 8 weeks wait,we weren't having it filed the cases 3 of them in the courts and now this has been announced and spoke with the courts todya and they said that it will be ajourned untill a decision has been made on the cases.
However filed a case with RBS (who is one of the banks signed up to go to court) in July,been away expecting to hear the same that they are putting it on hold and we have just received a letter today from them sent on the 22nd Aug offering us the full amount which is £2620. We are very confused now as to why and what this means for the other cases. We have to provide the courts with the breakdown of charges by the 6 th Sept and I will if they apply for a "stay" argue against it,and that i wish for the case to be heard now. You can only try. It is so frustrating that they have known this and have kept fobbing off people. All we did was follow everything that Martin advises.
We have been paid out in total over private and business accounts
Natwest £1300
Barclays owe £9500, we will have to wait and see.
If I were you I would write to the bank and advise them that there dealings on the particular case were unprofessional and that you will continue with the claim,and mention the amount of interest that will be accrued if this is going to take the time that it is reported to take with them going to court.

If you made the request under the Data Protection Act report them to the Information Commissioner.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
Got a cheque this morning (why didn't they just add it to my balance on my card??)
£271.39 including interest & court costs! Yay!!
In the space of four days I've got back RBS Credit Card, Monument Credit Card (phew... court date tomorrow!), & Simply Be/Ambrose Wilson (catalogue).

I do have an official letter from the bank dated 2nd May acknowledging the fact that I hadn't received my statements and they were reordering them on that date.
I was patient (fool that I was!) and didn't log a complaint - thought if I played fair and clean they might reciprocate!! hah :eek:
Anyway I do also have a contact at the local branch (where I intially started my claim and spoke to the same fellow re not receiving statements, etc) as well as contact details for that letter of May.
I am currently on maternity leave (additional maternity leave which means I am not on the payroll) so in a way yes I am hard up!!
As you are so well clued up I thought I might ask you which way now?? I know its worth a fight - £2274 to be precise!!

It does say that you should ask the bank to consider it as a hardship case (after all they have your details so can see if you're paying out more than is coming in and such like) explaining that maternity pay isn't of the equivalent amount that you would normally receive. Failing that, ask the Ombudsman for any further advice.
If you paid for your statements by cheque then you should be able to trace when that amount went out so that would imply that they got your letter asking for the statements a few days prior. It could be worth checking that date and count how many working days passed from then until the letter they sent you acknowledging not sending statements and seeing if it exceeds the 40 days they are allowed. If it was greater than 40 days you could try the Ombudsman again. I would assume though that you would have had to complain at the time and cannot do so retrospectivally.
How far you want to go and how far the bank and Ombudsman will let you go will be 2 completely different things. I wouldn't expect anything to happen but you never know unless you try. Going down the Hardship Case route would appear to be the most likely at the moment, it just depends on how they view hardship, and then it's proving it.0 -

Going to write a letter tonight - a polite one stating all my reasons appealing to their good nature (!) and see if that gets me anywhere.

Just looking for some advice here on what i should do with this shower Royal Bank of Scotland.
Back in February i wrote the usual letter from here and provided the appropriate cheque requested back statements. Nothing wrong there. However months past, and numerous phone calls to my branch proved fruitless. In the end i spoke with someone different at my branch "who offered" to do it right there and then, a few days later they turn up. (charged me the appropriate fee)This was in MAY/JUNE!!!! (4 months after i initially requested these) Around the same time the cheque got cashed!! (and no statements!!!) I made a point of complaining about this at the time and it would be logged.
I then did my searching through my statements to find they have charged me over 2000 pounds worth of charges. I sent this into the branch as instructed on the 14th July. The branch manager also remembers recieving it and sending it up, however a week or so ago i still hadnt heard anything from them and a snotty individual at the "customer support centre handling this said nope we have no case listed for you" So back to branch manager i sent it again to her again she sent it up and today i recived the bog standard reply about court case and so forth and so on.
Now the question is given the "stalling" tactics i have beenon the recieving end of can i legitamately fight this, because they got the letter before the 27th July. (confirmed by the branch manager)
Just like to add, i am a scot living in England but havent changed my branch for numerous reasons so how does that affect me?0 -

The call centre staff will not help with this one. Telephone 0131 556 8555 and ask to be put through to the chief executive office. They will ask why. Tell them you have a concern that cannot be answered by Customer relations as it's gone too far. Tell them your case at chief exec office. Their fax no is 0207 672 1796 if you want to follow up with a letter. I spoke to a lady there called Joanne Judd. They are dealing with a similar case on my behalf although they sorted my joint acct before the test case. Good luck!;)0
