It's a private car park and the blue badge scheme doesn't cover that, look in your handbook on this. But what does apply is the Equalities Act 2010, parking companies must make reasonable adjustments for disabled people, the disabled tax disc on show together with the blue badge albeit on the seat is not a reasonable adjustment.
You can either ignore this completely, or make a complaint to the retailer/s you were visiting. Head it 'shop name - Breach of Equalities Act 2010' demand that they get this dropped or you will sue them for said breach, provide a copy of a receipt if you wish.
If you want to go to the parking company to enter their bogus appeal process and then onto popla come back here for further advice, this is a more advanced method of dealing with them. Usually this route is used if you understand what's entailed and if the vehicle is not registered to you.
The BPA Code of Practice is below, note point 16.5 this parking company is breaking their trade body's cop by ticketing you, they know damn well these practices they should abide by.
16.1 The Equality Act 2010 says that providers of services to the public must make ‘reasonable adjustments’ to remove barriers which may discriminate against disabled people.
16.2 ‘Reasonable adjustments’ to prevent discrimination are likely to include larger ‘disabled’ parking spaces near to the entrance or amenities for disabled people whose mobility is impaired. It also could include lowered payment machines and other ways to pay if payment is required: for example, paying by phone.You and your staff also need to realise that some disabled people may take a long time to get to the payment machine.
16.5 If your landowner provides a concession that allows parking for disabled people, if a vehicle displays a valid Blue Badge you must not issue it with parking charge notices.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Just received a parking tariff notice from these cowboys for not displaying a valid disability badge permit in Cardiff Bay retail park at 6.50pm on the run up to Xmas, pay now at reduced fee of £60 within 14 days if not it's £100. Badge had actually fallen off dashboard and was on seat, & tax disc states disabled, no notice or information left on vehicle to state an alleged breach of parking event. Funny they should have written to me as obviously I am the vehicle owner, but do I drive the vehicle!! never driven in my life, so do NGP have to provide proof who the driver was? as I am under the impression that I am not legally bound to provide them with driver details, is this correct ? grateful for any help on this
You don't have to do anything at all, but I would if it were me! :mad:
You could just ignore the fake PCN and you would then need to ignore some more scary letters too, over several months. DO NOT PAY OF COURSE!
But I think you should complain to the Retail Park Management Company and NGP (not worded as an appeal full of excuses, no 'sorry', no 'please' and no 'thankyou'!). Demand that the fake PCN is cancelled immediately and ask for an apology as you are now loathe to ever shop there again.
Can you find email addresses for both, as this scam can be quickly knocked on the head by a complaint email to both, I bet. If you can't email them both then write a letter to both, again make sure you word it as a complaint, don't fall into the 'polite letter' trap because that won't work.
The Blue Badge is NOTHING to do with anyone in a private retail car park. The Blue badge scheme only applies on street; it is ONLY a Council scheme despite what the signs might say next to the disabled bays. Signs there should just say 'disabled parking only' (not 'Blue Badge parking only' = irrelevant).
You are disabled, legally entitled for your driver to park there, and anyway the tax disc and Badge on the seat would have been obvious to the idiot issuing the fake PCN so he should not have issued the ticket at all, it's illegal harassment and a breach of the Equality Act 2010 and the BPA code of Practice too.
Also try complaining in person to the Customer Service desk at the Retail Park if there is one, say how this has stressed you out. You are a disabled person, you were shopping there and it's simply NOT GOOD ENOUGH that you are going to be running scared of debt collector letters through the first months of 2013, all because of the Retail Park using an infamous PPC!

That lady realised the bigger picture as soon as we advised her - and she wrote a VERY strong complaint email. She sent it to the PPC and to the Managment Company as hers was the same situation as yours, in a Retail Park too. Read the thread carefully, she was at Glamorgan Vale Retail Park, maybe it's managed by the same people - because many retail parks are? You could send a pm to caryl2506 for help and guidance about how she achieved her cancellation, she started out as a newbie like you too and the person with the Blue Badge that had slipped down was her mother (also a non driver) so very very similar to your case indeed!
In that recent linked case, Glamorgan Vale Retail Park's management company got the fake PCN cancelled in two days flat! They really jumped to attention when they saw that the lady was very annoyed and that the situation was a breach of the Equality Act 2010 (use those words, because to harass you over this with letters IS a breach). And the parking company is the agent of the retail park so they are guilty of harassment & disability discrimination if they don't get this cancelled.

Sincere appreciation & gratitude to you all from an initially extremely worried & distressed pensioner, your replies have certainly put my mind at ease.
Incidentally this was Cardiff Bay Retail Park outside BHS store.
Just a little thought Coupon-mad when writing should I mention that I was not the driver and therefore had not entered into any contract to park at Cardiff Bay, and request that NGP themselves supply the driver details.
Have found e.mail contacts for the management Company of this site together with NGP contact email, also as an additional thought would it be worth writing a complaint to the store where we were parked.0 -
At this complaint stage I would keep it to the disability discrimination massive complaint as I think this will be cancelled; I suspect the management of the Retail site will see it as a real hot potato.
So at this stage, I don't think I would mention you were not the driver as that may steer NGP into their stock reply 'tell us who was then' which in fact is allowed under the protection of Freedoms Act (they can theoretically chase the registered keeper if they are not given driver's details). If this isn't cancelled and NGP refuse what they will read as an 'appeal' (your complaint) then you could reply that you'll be suing them then for Equality Act harassment of a disabled person, plus the Retail Park who contracted them...and by the way you weren't even driving...
I would indeed also suggest a complaint to the store where you were shopping, maybe a copy of the email printed out, plus a copy of the ticket and the blue badge and go in there brandishing it and ask for the Store Manager. Hi all,
I wonder if you can help me? I've also had a "notice to driver" from New Generation Parking, which they stuck to my car windscreen after I parked in a space reserved for a resident living at an apartment complex in Cardiff.
I've had a good look through the forum and found plenty of advice for people who have parked in shopping centre car parks, but not for people who have parked in a private apartment complex carpark.
I was there to visit a friend but did park in a space reserved for someone else. She thought it was a space belonging to an empty apartment, but when I got back I had a note on my windscreen from the person whose space it was and a notice stuck to the window from ngp.
The notice says my car is "parked in breach of the parking regulations onsite" and says it has been photographed for evidence.
Although the car park was half empty I can understand the other driver's frustration. There were also signs warning me, but I only noticed them on the way out! Plus the designated visitors' parking outside was coned off preventing anyone from parking there.
In short, I was aware of what I was doing when I took the space, but I don't agree that I should pay a fine to anyone for doing so - especially when none of it would go back to the person who was actually inconvenienced by me parking there!
My question is - can I ignore it or, because it isn't exactly an "unfair" notice (I knew what I was doing and there were signs) do I have to cough up?
Any help you can give me will be hugely appreciated!

I've had a parking notice from New Generation because I parked in a disabled spot at Boots in Cardiff Bay....I've never done this before but I was desperate to pick up a prescription. Before now I have driven away from shops because there have been no ordinary spaces available but loads of empty disabled spaces especially at Cardiff Bay retail park on a Saturday afternoon.
I'm glad everybody says to ignore it £60.00 they want if paid in 14 days £100 if longer. But reading everybody's experiences I'm amazed at all the different charges people have been "fined" it does seem to be a bit of a "pick a number, any number" kind of outfit0 -

And we noticed that some PPCs charge more here in my neck of the woods in Brighton and Hove and Worthing - 'cos they must think we're stupid and made of money - then the same outfit allege is the amount due in some other cities.
Just tick off the letters against the pics in the 'PPC letter chains' thread near the top of this forum. But please look at the gallery of pictures shown as 'PRE-OCTOBER' because the letters have generally not changed ( and the post-October link is a work in progress with very few pics so far).PRIVATE 'PCN'?
