I took my mother who has dementia to the retail park this afternoon and parked in the disabled bay since she has difficulty getting out without opening the door fully. She has a blue badge but I failed to display it due to recently changing my car and it was still in the glovebox. I returned to my car to find a Parking Charge Notice for £60 from UKCPS Ltd. I found the gentleman who had placed it on my car and explained the situation and showed the card. He told me to appeal? Any advice on this. Thanks

Ignore it and any thing they might send you. That's the easiest and simplest way to deal with the silly ticket.

If you are the registered keeper of the vehicle the easiest thing to do is ignore as mentioned. There is an alternative available that you could do but it involves some research and time for you, if that is at a premium just ignore. Be wary of anyone passing private messages to you who has less than 500 posts, Peter Haswell a manager from that company lurks on here and tries to garner information from unsuspecting people here, don't you petey boy ;) please edit out where and when you got this fake ticket, just press edit
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?
• Bottom line: the demand is NOT payable. It is a scam as is every document issued by private parking companies.

First, sit tight, don't write to them, don't move an inch. Let them chase like rats by first buying keeper details from the DVLA, and then just see if their threatogram mentions Schedule 4 of the Protection of Freedoms Bill. If so, we'll get you to write to UKPC rejecting the demand, then when they "turn down your rejection", you do the same with POPLA as this will cost UKPC £32, and then you ignore everything from everyone except the court. if you go to court, it will be to win hands down, hence the reason nobody will sue you.

The Blue Badge scheme does not apply on private land at all (despite what may be on the signs).

If disabled bays are provided in a private car park then they can legally be used by any driver/passenger who needs to use that bay and meets the 'definition of disability' under the Equality Act 2010. Someone with a Blue Badge does meet that definition but it's not the be-all and end-all because other disabled people may not have a Badge and can still use the bay, by law, if they need to by virtue of their protected condition.

The fact is that you found the employee and showed him that the passenger was indeed disabled. So with that knowledge, for the PPC to pursue the charge now would be disability discrimination under the Act. They 'knew or should have known' (words from the Act) that the person was disabled and so they cannot harass or discriminate against you/her. So they cannot lawfully harass you for money now.

I would appeal with a copy of the Blue Badge and point out that you also told the employee on site about the disability, so he was aware that you were allowed to use the bay. So you request that the ticket is cancelled. Keep it simple!

Leave it at that and if they cancel = good. Please let us know. :)

If they don't, come back here and one of the regulars here can help you to appeal to POPLA to expose this illegality and to cost the PPC money. It's part of the BPA Code of Practice that all PPCs have to abide by the law (of course!) and anything other than cancelling the ticket, in these circumstances, would be a breach.

As already said, DO NOT REPLY to any pm from a poster with less than hundreds of posts. Don't give any more details here whilst the fake PCN is still in play and you may wish to remove the retail park name from your post. UKCPS are obsessed with our forum...

Hi good morning. You must do and follow the advice given. Couponmad. Bargepole. Bradford lad . Tristonia. Taffy. Manx. Renegade and way to many to mention are folk that have been around this site for years. Their time and effort is not a financial incentive for the thousands of posts they have put up. I was helped big time as no money really to speak of to give away. The tickets I received were pointless. APPEALING was pointless. The permit I have is valid at 120 a year!!!!. Yet tickets still issued. I am close to a thousand pounds better of the to their support, I will confess a couple of tickets I got were due to my enlightened mind on the ppc.
They rely on the fact as a whole the nation get an official looking bit of paper in a yellow plastic wallet slapped on the windscreen.
Stick it through. Keep your thread updated and you will get free advice all the way. The guys do not want you to be scammed and the site wouldn't allow people to put up dodgy posts.
Well done for finding the site and please please inform your nearest and dearest.
The word about the scammers is spreading like marmite here in the westcountry.
We workers all love it and the ppc hate it :rotfl:
• Thank you all for your replies and advice. I have been looking after my mother with no help or financial support from social services for over a year now - all her income is going on the daily care she needs from carers as I need to continue working to pay the house hold bills. I really could do without paying £60/£100 for simply forgetting to put the badge on display and actually had her in the car with me as I have no carers at the weekend.
One of the posts (Coupon mad) says I should appeal - do I bother or just sit tight ?
So pleased that you are all out there to help.

It really depends on you. Most of us that post on here are up for taking on the bullies ( Coupon Mad being a leader in it ! :T ) but if you want a quiet life then just ignore them. If on the other hand you want to help us give them a kick in the knackers then appeal.
All aboard the Gus Bus !
• Have decided to appeal to UKCPS with all the information you have given me and sending a copy of my mother's Blue Badge and the fact I showed it to their employee. Do I put my address on the letter giving it to them for free or let them find me through the DVLA? I was also going to send a copy to the owners of the car park. Do I mention I have no intention of paying it? Thanks

It's up to you whether you use an address, you could email if that's offered and then that makes them buy your address - but then it's only £2.50 for them.

As I said before, I think you should appeal. Enclose a copy of the Blue Badge and point out that you also told the employee on site about the disability, so he was aware that you were legally allowed to use the bay. So you request that the ticket is cancelled. Keep it simple!

• I've just sent an email to UKCPS with an attachment of a picture of my mother's blue badge. Hopefully this will be the end of the matter but I'll let you all know. Thanks for all the advice.

While shopping in Glamorgan Vale Retail Park on Sunday 21/10/12 with my mother I recieved a Parking Charge notice issue number 866908 for not diplaying my mother's Blue Badge whilst in a disabled bay.

My mother walks with the aid of a walking stick due to arthritis and has difficulty getting out of the car without opening it fully. She also has severe dementia and has no understanding of traffic and therefore meets the 'definition of disability' under the Equality Act 2010.

I informed your employee on site about the disability and showed him the Blue Badge so he was fully aware that we were legally allowed to use the bay.

I therefore request that this Parking Charge Notice be cancelled and have attached a photo of both sides of my mother's Blue Badge.

I will also be forwarding a copy of this email to the owners of the Retail Park, Edgerley Simpson Howe LLP.
