New Generation Parking "Fine"

Can you please help with this as my wife is scared and wants to pay £150 to the above bunch of monkeys that I don't want to pay.

In Mid Dec I parked in a disabled spot in a retail park in Cardiff. I had no idea it was disabled at the time as it was not clearly marked and it was dark. I was there for 10 mins or so. I then get a parking charge notice from NGP saying I must pay £65 within 7 days but then it increased up to £150 if I left it. I did some digging on here and as the car is in my wifes name and I was driving I got her to email and say she is not going to divulge who was driving. In the meantime I went back to the spot and looked at how I could have missed the fact I had parked in a disabled spot. All of the spaces were marked so faintly you literally had to stare hard to even see they were disabled spots. I had no phone on me but went back a few days later to take some photo's and alas, the spaces had been repainted bright yellow.

We got an email back quoting "Norwich Pharmacal Order" and that we had to dicsloe the driver. I repiled again stating that the disabled spots had just been repainted and that they could take me to court if they wanted as someone would have a record showing the spots had been repainted 'after' I had parked there. They replied ignoring this and just saying "you should have had your badge on display" cleary not reading my mail correctly so I just ignored them.

Today we get another letter threatening with debt colllectors and court action etc.

My stance is f**k them, take me to court, I've never parked illegally before and this was a genuine accident due to the road paint needing to be re-done and I'm confident any judge would throw it out if he could see records of when they were repainted. The wife on the other hand is bricking it suggesting we just cough up £150 - I don't want to.

Any thoughts, ideas and suggestions please?

    I would stick with your stance all you will get are letters for your bin.

    Ignore these chancers. A few more letters and then you are done, but don't have any more correspondence with them though.

    I was just reading a thread about some guys ignoring and it works. So ignore them! They also say keep SILENT! DO not get in touch with them from now on. Regardless of what they say.

    Re post on the parking thread on here, they will tell you the same.

    It isn't a fine, it has no legal standing and they can go whistle. All you will get is a few official letters made to scare you into paying.
    For heavens sake don't pay it.

    Ignore the scammers and don't be put-off by the threat of an NPO - That is a very expensive legal device that can only be sought in higher courts than these pond life use.

    Private disabled bays have no legal standing anyway - ignore.
  • Same has happened to me. I assume it was Cardiff Bay retail park? If so I have photos showing parent-and toddler bays overpainted with disabled bays, disabled-bays overpainted overlapping normal bays...I can't see any court taking them seriously.

    IF yours ever gets to court, I'm happy to share the photos, but since I specifically requested a court date from them in January, and they simply carry on threatening me, I can only assume they have not intention of taking me to court, and rely on their bullying working. Anyone have ay experience to the contrary?

    For the record, my MP has asked the minister for consumer affairs to investigate what they're up to.

    Like most PPCs, NGP have never done Court and wouldn't have a clue. And you'd win anyway. Won't happen though.

    Good on you for involving your MP; these PPC scams are a scandal.
