Hi, I wonder if anyone could tell me if this email sounds ok? I've had a partial offer from Central Trust about a First Plus loan. The original complaint was rejected because I'd mentioned being told it was compulsory, but they've admitted front loading it was wrong. I'm not sure how they can say 'we did mis-sell a policy, but because we don't think we did in the way you said, and just in this other way, we're not giving you the full amount'. It's insane. Anyway, I wanted to reply with:

We recently received an offer for the mis selling of the PPI on our loan.

Having thoroughly read the initial letter, I would firstly like to point out that being told it was a condition of the loan did not happen at the time of the initial sales call, but after receiving the loan particulars and before signing and returning them. We called to query it as it was such a large amount, and were told then the loan would only be accepted with PPI.

However, this is largely incidental because, as you have mentioned, the way that the PPI was applied, as a front loaded, separate loan is deemed as a mis-sell under the Financial Ombudsman’s rules, and therefore I see no reason for an offer of anything less than full redress.

I would like you to provide us with revised offer of the full amount paid, minus rebate plus interest, or we will refer it to the Financial Ombudsman who are extremely likely to find in our favour.

    Regards,
    me.

However, I feel like I shot myself in the foot by mentioning what we were told (as above, they listened to a phone call, but not the relevant one) and I'm reluctant to make the same mistake again!

    Any tips?
I have done you a letter on your other post :D

Hi I'm a first time poster on here..

I currently have ppi missing claims in with northern rock and egg/barclaycard still awaiting a response from nram who acknowledged my claim end of January. Egg/barclaycard gave me a resolution date of 19th March as the date had passed I rang them to be told they'd just sent me a letter asking for more time but that I can take it to the FOS if I want, bloke on the phone said I'm better of giving them a few more weeks for the outcome, think this will be what I'll do.

I'm in exactly the same boat with Egg/Barclaycard. They should have responded by 20th March, called them and they said they need more time to get the original application form. Think it's just stalling tactics. I'm going to call them every Tuesday for 3 weeks and if not resolved to my satisfaction then I'll be off to the FOS.

    Help please!

I wrote to Nat West Credit Card Service about Payment Protection Insurance, quoting sections 77-79, requesting a copy of my t&c's and asking for my PPI to be cancelled. Their response - reduce my limit on my credit 10 fold and sendthrough a "Default Sum Notice" along with a £12 charge for going over my new limit!

I have apparently triggered a warning and it is standard procedure. The only way to get the credit limit raised back up again is to apply for a new card & pay off the old one.

Is this just a delaying tactic to put me off?

    Any suggestions?

Hi Gav the crap coming from these companies is unbelievable they cannot do this, threaten to contact the fsa and put in a complaint.

    Hi all...

....well RBS have finally come back to me stating that they will not review their 'goodwill' offer without proof of PPI premiums paid going back further than 6 years, the question is whether an SAR would be worth the £10, in other words would it be likely to provide statements going back more than 6 years (the card was opened in 1992 with PPI from the start). Also as RBS have not yet admitted any liability for a PPI mis sell and only offered a goodwill payment because they cannot complete their enqiries within the prescribed timescale would it be worth going to FOS for them to investigate and if FOS upheld in my favour would I still get the same offer of redress based on not being able to provide proof of premiums further back than 6 years ?

All advice is very much appreciated..

You may get the info you need from a Sar but then again you may not, without proof FOS will side with the bank, i would not like to tell you what to do to be honest, hopefully someone will advise more on this.
