    You would complain to the IFA.

    However, if the insurance was Friends Provident then that means it isnt PPI. Friends Provident were a life assurance company.

    Most people take out life assurance with their mortgage. Why do you think it is wrong in your case (or are you mixing it up with PPI by mistake)?

    Also, your mention of Abbey National indicates this all occurred before insurance regulation started. So, the IFA is not required to consider your complaint any way.

  • Hi All,
    I sent a letter to Santander re mortgage PPi asking for copy of Consumer credit agreement and a list of all payments made and this was the reponse I got:
    'Further to your recent letter, we have now completed a search of our systems for data and can confirm that this mortgage was not regulated by the Consumer Credit Act and therefore does not have a credit agreement'..............
    I was unsure so rang the PPi complaint line and they gave me the reference number for the PPI account!!! I had read the letter and iferred that they were saying I didn' t have PPI!!
    ANyway, complaint is now filed so fingers crossed but think this first reply from them was very misleading!

    its not misleading. it is correct.

    Mortgages were not regulated under the consumer credit act. So, if you ask for a credit agreement on a mortgage then you are making the wrong request.

    They answered your question as you asked it. The problem was you are asking for something that doesnt exist.

  • Thanks for that, clears it up. Although they did fail to do the other part of the request which was to send statement details so they're not totally off the hook lol :)

    I've been Money Tipped!
    I wrote to Lloyds bank via their website and over the last 2 days I've received 9 packets full of documents for me to fill in. Baiscally it's 1 x MPPI, 1 x card and 1 x loan, but they've sent me 3 sets of documents for each.

    Looks like war and peace on my desk!

  • Yes, sent a cheque with the letter but there was no mention of that part of my request in their response. However, the lady I spoke to asked for this to be added onto my complaint.

    If you sent the £1 method then that is not applicable. It requires the £10 method (DSAR). However, even then, you only get statements if they still hold statements.

    I started a PPI claim for my mum through Resolver back in May i think for Catalog payments to Littlewoods (Shop Direct Limited i think). They sent a form to fill in, basically replicating what I had entered on Resolver. Nothing has gone through Resolver since, all correspondence has been direct by mail.

    After a few months I contacted them to get an update, apparently their reply was sent but we had not received it. We promptly received it a couple of days later. They admitted we had PPI for a period of 5 years before my mum cancelled it from 2009 onwards, however, they said they did not believe the PPI was missold in this case and said they would close it if they did not hear back.

    I then went to the financial ombudsman website and will in a form, as well as filling in the same questionnaire again :)

    A couple of days ago, we had letter from the financial ombudsman saying that Littlewoods had agreed to make my mum an offer in line with the ombudsman guidelines. We may need to wait another 8 weeks to allow littlewoods (or I think it is now Aviva?) time to calculate the amount.

    It made us think though, how many would have given up and not escalated it to the Financial Ombudsman, when the claim was rejected, quite a few I would have imagined.

    We have no idea how much was paid as we do not have any statements from back then, so we have no idea how much the offer will be for, we will wait and see.
