Claims Management Companies can't somehow magic up account numbers or other personal financial details. Any research that is done is down to yourself.
Don't waste money on paying any company what you can do yourself alone and for free.
If you need help there is a wealthy of information on this site and people ready and willing to help you if you have a genuine mis-selling complaint.
  • I was contacted by the fsca with regards to ppi sold to me my welcome finance, my ppi claim was upheld but now they've used my ppi award to offset against another loan I had with the same company is this legal

    Yes. Setting off rules are in the link;

  • I need help and advice on where to go from here?

I have received numerous phone calls saying that "they can claim on your behalf" any PPI due, but they are wanting 30% of whatever you get, anyway, they said it does not matter how far back the loans were as long as PPI was involved.

    My questions are:

    1. I have had 2 loans in the past from a high street bank, but date back to over 16 years ago, can I still make a claim?

    2. The first loan was paid off, but the second loan I had to use the PPI as I was finished from work due to contracting RSI so I claimed on the PPI, is there still a claim for this loan?

Any help will be greatly received.

    TIA (thanks in advance)

You can still complain about these. The further back you go, the chances of records no longer existing can occur but that is the only potential issue. A claims company cannot avoid that and there is no difference to them doing it or you doing it.

It is probably important to put you off the use of the word claim. What you are actually proposing is to make a complaint. Not a claim. Claim is what you made on the policy when you suffered an insurable event. It is just the claim has been hijacked now to mean complain. In your case, it could cause confusion as you are asking if you can claim even though you made a claim.

Yes, you can still complain about PPI even if it paid out. However, if your complaint is successful, they can reduce deduct the amount paid out from any redress due to you. If the claim payout was greater than the premium paid then you get no redress payment. Also, because the policy paid out, it reduces the reasons you can use for your complaint. For example, you cant say you didnt know about it or that you were ineligible or that you didnt need it. You would need to give another failure reason.

Do you actually have reasons for complaint?

  • We have had credit cards over the years with most lenders (some joint, some individual) and loans too!! If asked we have always said no to ppi. Could we still have paid it?? As these are no longer active accounts we don't have any documentation or even account numbers on record.
1, Is it possible that we could 've been paying PPI without our knowledge?
2, If yes, can we claim for mis sold ppi without knowing any account details or even for sure if we were paying?

    I'd appreciate any advice please!

Only if you never looked at statements or read loan agreements you signed. For your credit cards, for example, the PPI would have been on every monthly statement (on a separate line) when your account had a balance.

You can complain (not claim) about the sale of PPI if you have valid reasons to do so. You cannot complain about "phantom" policies that you are not even sure you had.

You'll therefore have to research any PPI prior to any complaint. You can start by asking the providers of your loans and credit cards if they have records of any PPI on your accounts. They can normally find you by your address(es), but account numbers etc do make it easier.

If you want all details held on file for you by an individual provider then you can send a Subject Access Request (SAR) letter costing £10 for each.

To be honest, if, as you say, you always declined PPI when offered it then it's very unlikely that you ever had the insurance. It's a myth sponsored by claim companies that PPI was randomly added without the knowledge and permission of customers.
  • moneyineptitude thank you for your reply.
I think its very unlikely then that we have been paying ppi. I certainly would have noticed it on credit card statements.
    Kind regards.

Nothing to stop you speculatively asking your loan providers if they can find any PPI attached to your accounts. As you say, they'll likely just confirm what you think already.

In your circumstance, I'd only send SAR letters if I was particularly mistrustful of the Bank. At £10 each, it could prove very expensive otherwise and with little likely reward.
  • I also didn't think I was entitled to claim but after reading Martin Lewis website and having a better understanding of how and what to do I did it. I filled out the forms even though I didn't have all the paperwork. L filled paperwork for my daughter, husband and myself. My daughter heard first and she was offered £5.500. I heard next and I won £9000. Hubby then heard and he was offered £13.000. I'm still in shock! All I can say and advise to anyone thinking about it STOP FILL THE FORM IN. I didn't have all info but I wrote as much info as I could, even old addresses,D O B etc. I'm still in shock! But it's slowly sinking in. By the way the bank CONCERNED was HSBC.
