There is certainly no link between complaint success and using a claims company. The claims company uses the same free-of-charge complaint process and the only difference is they charge a hefty commission for "representation".
You don't say why the Ombudsman has rejected your complaint, but unless you have new and compelling evidence not in your original complaint then there is little point appealing the decision. Your other successes really are irrelevant. The bank may even have decided to auto-pay the other complaints without any investigation (you'll never know since banks don't reveal uphold reasons).
First of all, thank you for taking the time for your reply and yes, you are right, about that they treat every complaint differently and we surely do know that. The thing is, that it just surprised us that they rejected this specific one, when the reasons were exactly the same as with the two where he's received the money back.
The Ombudsman rejected it on the basis that the Insurance has been taken out some time after he took out the credit card and that it was suitable for his needs at that time, which I doubt very much.
It's just when you read through the reasons that, for example: "The cost of the policy was £0.79 per £100.00 of the outstanding monthly balance. If he made a successful claim, the PPI policy would cover 10% of the outstanding monthly balance on his credit card".
I'm pretty sure that if he would've been made fully aware of the actual money he would've received, he would've never have taken it out in the first place. In that respect, I believe that it was mis-sold and that's always been our argument, that it was never completely explained.

The fact a CMC was used doesnt mean a thing. The smaller ones may have been auto paid out due to their size. Or maybe there is a failing in the sales process for those but nothing in the others.
Yes, thank you. It wasn't my intention to make it sound like I would support PPI companies, which I don't. I have claimed my own back through here and have been successful.
I just wanted to point out that the previous ones were going through a PPI company. The only reason for this was that he went through an IVA and this specific company was recommended to him at that time. In retrospect we wished that we would've done it ourselves but that's too late to worry about it now.0 -

I have a question and would be happy if I could get some suggestions...
My partner has been turned down by the Ombudsman regarding his credit card PPI. The thing is that he's already received back two smaller PPI payments from Barclays, which went through a PPI company, while this one didn't go through a PPI company.
We are obviously surprised about the outcome considering the previous two payments. We would quite like to use this as an argument but we're not sure how to handle this specifically.
Any suggestions?
You can't use this as an argument. You are complaining about the process that was used to sell a particular policy. You can't therefore use an upheld complaint about the process used to sell a different policy at a different time to seek to argue the decision. Even if it was the same bank (you haven't said) and they admitted liability in the other matter (which I doubt).
Whether you use a CMC or not makes no difference especially not to the FOS whose uphold rates are identical for CMC and non CMC complaints.
Like Money Ineptitude said it may have been that the other two payments were so small it wasn't worth the bother of disputing it when you factor in the possible FOS costs.0 -
I had a bad day at work today and when I got home I opened a letter and the first thing I saw was my ppi claim with halifax was upheld. Can you just imagine how ecstatic I felt? Anyway, when I sat down and read the entire letter it stated it will paid to the OR . I filed for bankruptcy in 2005. I am in financial difficulties again and the amount halifax will pay will definitely make a huge difference ( for one I need glassess but cannot afford one and my grandma who lives abroad is showing signs of dementia and I want to see her before she totally forgets me . If she dies I won't be able to attend her funeral). So I searched for information and I ended up here. So my question is since it's been 8 years since I was discharged and I was told that the bankruptcy won't show on credit score anymore (as in clean slate) where will the PPI money go? I have this idea that my creditors would have erased all records of me by now. So it's like re-opening all records of my debt?0

Your debts were written off, not paid off, so the money received from the PPI will be distributed amongst your former creditors.
You only have the right to complain about the sle of PPI if it occurred after your discharge [ I'm only using that as a barometer because you would have been unlikely to have had credit extended for a while after delcaring banruptcy]Non me fac calcitrare tuum culi0 -
Bankrupts cannot benefit personally from PPI complaints and any redress goes to the Official Receiver for redistribution to your former creditors. You did not really think you could get a refund of money you never paid in the first place?So my question is since it's been 8 years since I was discharged and I was told that the bankruptcy won't show on credit score anymore (as in clean slate) where will the PPI money go?
Exactly. It's you who are re-opening these records by complaining about finance which your bankruptcy was supposed to draw a line under to allow you a fresh start.So it's like re-opening all records of my debt?

Almost 5 years ago I took out a mortgage with Halifax through an IFA. Halifax informed me through the IFA that I had to have life insurance in order to get the mortgage. So a life insurance was organised with Friends Life and I have been paying it since.
Would this be classed as being mis sold and if so, who should I contact about it?

Life insurance is not PPI and (unless you are immortal) it's difficult to envision any circumstance where this might have been mis-sold to you.
It would only be be "mis-sold" if you were told it was compulsory when it wasn't.0 -

Firstly, life assurance is not PPI.
It is a very common requirement of mortgage advisers to buy the insurance through them to get the free mortgage advice. That model is allowed as long as the insurance sold is suitable for the needs.
Most people take out life assurance with their mortgage. So, unless you are single (living alone) or immortal

Does anyone know how far back you can make a claim? I had a loan with Halifax and was made redundant so I paid the loan off with my redundancy money. I then found out a week or so later I had insurance so I went into bank and was told you hae cleared the loan so too late. That was 22 years ago...............is it too old?0
