PPI Reclaiming Discussion Part 5

  • Hi, I hope I'm in the right place! I've just posted 4 requests off, one for a loan and 3 for credit cards to see if ppi was being charged. What happens next? I've had a quick look at the questionnaire questions and to be honest I cannot remember ever being asked about ppi! Would I just say that on the questionnaire, I never even knew I had been paying it!

If you had PPI on your credit cards it would show on every monthly statement. For loans, it's on the agreement you signed.

I have made a complaint to NW regarding a credit card PPI policy that i did not know I had that ran for nearly 7 years. My circumstances were as follows:

    1) I applied for the card at my local branch - i did this before i went travelling for a year and bit.
    2) I got the card to cover emergencies despite having significant savings in the bank (i.e. it wasnt a loan, simply a backup)
    3) I was unemployed when I took the card out and had no intention of working for the period I was travelling.
    4) I already had medical insurance as part of my travel insurance.

    My complaint is as follows:

    1) I simply did not know that I had the policy or what the policy was for.
    2) That it was miss-sold and inappropriate because:
    a) I was unemployed at the time and was intending on staying unemployed for a significant period of time due to my travels (~18 months - does this make the unemployment cover inappropriate?)
    b) I already had medical cover through travel insurance (again, doesnt this mean i didnt need the medical cover)
    c) When i started full time employment (~14 months later) I had serious injury and illness cover was part of my employment (likewise, the policy was redundant)

It's #1 that really upsets me, I just had no idea i'd been sold it and it wasnt for many years (until i grew up and took more interest in my finances) that i spotted it and questioned the charges.

RBS/NW have since come back and asked me the following questions:

    1) How long was I travelling for?
    2) How long was I out of work ?
    3) Was I UK resident at the time?

I am surprised by these questions as i provided answers to #1 and #2 in my original complaint. Does anyone know the relevance of these questions in relation to my complaint / recognized PPI claims?

Thanks for you help and support.

    Regards,
    SHA

    c) When i started full time employment (~14 months later) I had serious injury and illness cover was part of my employment (likewise, the policy was redundant)

Irrelevant. Mis-sale relates to point of sale. Not what happens 14 months later.
    b) I already had medical cover through travel insurance (again, doesnt this mean i didnt need the medical cover)

Irrelevant. there is no overlap with PPI and travel insurance.
    a) I was unemployed at the time and was intending on staying unemployed for a significant period of time due to my travels (~18 months - does this make the unemployment cover inappropriate?)

That is a solid complaint reason.

They are making sure that you were not just away from work for a short period and verifying eligibility. They are responding to the solid part of your complaint. The weaker parts are not being covered as they are irrelevant and you wouldn't succeed on those.

So it is inappropriate due to me being unemployed at the time, thanks.

I would stand by my claim that it was miss-sold based upon the fact that the significant features of the product were not made adequately clear to me at the time though too, regardless of eligibility.

Any idea why they want to know whether i was UK resident at the time of the sale?

You had to be resident in the UK in order to purchase (and claim) on the insurance.
  • 18 months ago I stupidly used a claims company to claim my ppi. Although my loans at the bank had been upheld I only had one policy number from a recent loan, this was the only information my bank gave to the claim company and they billed me for the amount owing based on that number. The bank then rewarded me ppi money back on other loans I had previous . 18 months later the claim company have sent a letter asking me for permission to request a sar from my bank. Just wondering were I stand with this because I understand I have or did have a contract with them but I didn t supply policy numbers. Am I now obliged to give them numbers to do he aparent work the bank has already done?
  • Check the terms of the legally-binding contract you have with them.

Why are the company requesting to send a SAR only now? Have they been "tipped off" that you have had other finance with the bank?

I don't see any reason why you shouldn't refuse any more permission to the Claims Company and tell them to cease chasing, but you'll need to check the contract to be sure.

Is the "gesture" full redress, or part? if it is part why?.
Many thanks, I will try that! With regard to your question, the response I have had is "we are unable to confirm that your PPI was appropriate for your needs or that it was adequately explained to you. As a gesture of goodwill..". Yes, it is full redress.

I originally told them I had more than 1loan but didn't have the numbers
They sent forms out for me to sign that were virtually blank that is the only thing they have. The bank only informed them of the number they gave so I feel that I shouldn't give them numbers to do something the bank has already done.....they did sent some forms a while ago asking for policy number s and I put them in the bin and ignored them.
