    I have had major issues geting hold of royal sun alliance, this policy is back from 1998 and i have not had any response to a letter i sent them last year. Any suggestions please?

    Are you certain the policy was SOLD by the Insurance Company? Normally the Insurance Company is only the provider of the policy and a mis-selling complaint should go to the seller of the PPI. This would be the mortgage provider.

    It's a long time ago ( 16 years!) and if you have no documentation from your own archive there is only a very narrow chance that the lender has either.

    You can send a Subject Access Request (SAR) letter to Royal Sun Alliance (or more likely whoever sold you the Insurance) to see what records are left, but as this will cost £10, be certain you can afford to spend this amount with little prospect of progressing any complaint.

    This is a really weak complaint which would be quickly countered by the "Demands and Needs" statement and the signed mortgage agreement.

    It's not looking good, I'm afraid.

    i have the original documents to hand, statements and the original contract....
    Can you advise me why its a weak argument, if someone sells me something i need... surely the have a duty to explain to me what i am paying for ? if i dont know why i have paid for a protection insurance then surely there is a mis sell.... i have the documentation but i cannot get through to anyone, surely i am better taking to FOS? for a cost of a stamp im only going to find answers... even if they dont accept the fact im not sure about the product, surely being told i need to take it out to secure my application is a pure mi sell ?

    So you are saying there is no breakdown of what the insurance covers in your documentation? It's only a mis-sell if they told you inaccurate information or if the PPI would not have covered you

    As already stated, you have no access to FOS until you have given the seller a proper opportunity to consider your concerns.

    With mortgages it's possible that the PPI was compulsory. However, even if it wasn't ,how are you going to prove that you were told it was? your mortgage paperwork will clearly show that it was optional and that you signed to accept it.

    You first of all need to get it in writing, unless you already have, that the company are not acting for you any more and that the contract is cancelled, make sure you have this otherwise if you make the claim and win, the company will send a bill.
    Once you have this, make the claim to the bank and let them know you are not using a third party company.
  • Please can anyone help and I hope I have posted correctly as this is my 1st time so please be patient. I hope to make a claim for PPI relating to 2 loans taken out by myself and my husband (we are now divorced) in the 1990s with HFC bank. At the time the separate loans were for £3000. and £300. both for which we paid extortionate PPI. A condition of the loan was PPI and there was no choice as they were sold as one and PPI as I recall was well more expensive to pay back than the loans. As we are both still in contact with each other but have no details of the loans can we still make any claims. Also in the 1990s my husband tried to claim on the policy as he lost his job and was told as I was working at the time I was to support him and the PPI did not cover his loss of job. That was not our understanding at all. Generally we wouldn't have been so bothered only we know the claim could be possibly worth a lot of money. Please can anyone offer any advice?????????

    If you feel you have a valid mis-selling complaint send it to HSBC (not HFC who no longer trade).
    Do you have any documentation for this old account? If not, you'll doubtless struggle as records will likely no longer exist.
  • Unfortunately as we are divorced we have no records of the loans. Does this mean its a no ?. As its very frustrating. Any suggestions ??????????

    You can still complain but, without any documentation of your own, the complaint will likely be declined due to there no longer being any records from fifteen years ago...
  • Help please.
    Its a bit of a story, but basically by early 2003 both my wife and myself had a hell of a debt problem, owing money on cards and loans, the majority of which had payment protection insurance associated to them. Any ways we were in trouble and went into a debt management plan with a supposed leading company. It was not an IVA or Bankruptcy! we sacked them in 2007 and negotiated directly with our creditors. I'm pleased to say were now debt free.
    However , as i said earlier the majority of the debts had ppi one in particular was my wifes HSBC credit card. She had this since about 1990 and paid ppi on the balance .
    We have approached HSBC regarding the ppi , filled in forms but they say they have no record and have received a letter saying they've closed our claim.
    in the mean time we have found statements for late 2002 early 2003 which show ppi being paid and we have now sent these of to HSBC.
    My question is will they reactivate the claim and for what period will they base the claim.
    please help as Im confused.
