    Being told you have to have it when you dont is a mis-sale. That bit is not in doubt. The problem is that it is a near impossible one to prove. You almost certainly have nothing to show that happened and you can bet your life that the lender has nothing. So, without evidence it happened, you tend to find that point is rejected.

    When you raise a complaint, the firm has to check the sale of the policy was correct. Even in areas you have not raised. So, what sometimes happens is that you can complain with a weak reason but get your complaint upheld on something you were not even aware of. Also, some lenders have a floor limit where they auto payout without investigation if the redress is below a certain amount (cheaper to settle than to argue).

    Other reasons are much more solid. Single premium MPPI is considered bad 99% of the time. having employer sick pay for 6 months full pay/6 months half pay works well with loan and credit card PPI (but not MPPI). Haivng a major pre-existing condition etc. These are all easily supported factual reasons.

    You should make your complaint and send it off. However, also make sure you state you want it cancelled. Sometimes the complaint handlers only look at your complaint but dont actually cancel it because of your complaint unless you say so.

    The "full and final" responses are pretty generic and those which decline the complaint all include details both of how to apply to FOS and the time limits which apply. The lenders are also required to include a copy of the FOS booklet which also outlines these details.


    Pretty much.

    It's not just the ones that decline the complaint. ALL final decision letters are required to advise of the FOS rights and the time limit. Even if the complainant never had any PPI!

    Whilst its unlikely that the response wouldn't have contained this info it's not unheard of. I remember hearing about a reasonable sized product provider (can't remember who unfortunately) who were carrying out a past book review into sales of a particular product and forgot to include the six month time frame in their decision letter template. With the result that FOS ended up considering each and every complaint against them regardless of time frames because the complainants had never been told that there was one.

    I agree it is a long shot as you would not expect that sort of schoolboy error from a company of HSBC's standing, but the OP really needs to check the letter.

    Hi guys long time no speak to, been so busy chasing ppi's up, no seriously jackies gone back to work so i don't get nowhere near so much time now,I've a query for you guys who are a lot more in the loop now than i am which Is just about everyone, tsb (yes Di still waiting) had 12 weeks to make me an offer and pay me out, decision upheld by ombudsman 16 weeks on no communication, ombudsman chasing don't think there going to have any luck. Can I still enforce this uphold through the courts.:mad::mad::mad::mad::mad::mad::mad:

    thanks lorraine and taff i've got ceo's address have been contemplating emailing him anyway but did'nt know whether to as ombudsman already involved and supposedly chasing them, what a bunch of cads eh, I think there hanging about because It's for a few quid and they just want to linger,:) my mate got 34k off them a few years ago,anyway how are you all. :):):):)

    Bit of advice please.
    Have started a claim for the wife on a open account but my history is a bit more difficult. Ive decided I want to try and tackle it but not sure the best process.

    HSBC mortgate - ongoing
    Virgin card - closed
    Tesco card - closed
    Egg card - closed
    Probably a few more too.

    I'll get an updated credit check and I've got some older ones from a few years back. Is it just a matter of phoning round the providers and asking If I had PPI?

    I have seen the template letter for closed accounts but this seems to ask for paperwork rather than just whether PPI was charged or not. Is this the right letter?

    Any advice on getting started?
