  • Thats what I'm complaining about, the sale of it, not that I took it. They should never have sold it to me as I didn't require it (due to the benefits of my job which I explained), if I understand the process correctly then I am due a refund.

    No one is due a refund.

    You have to prove it was missold in some way...which is what you are saying by saying you didn't need it due to work benefits etc.

    Again, no one is due a refund. You are making a complaint it was missold, not 'claiming it back'

    If you had the account numbers and complained, your complaint is over.

    If you didn't have the account numbers, you send them a SAR and £10 to see what info is left.

    If that comes back with nothing, your complaint is over.
    If it comes back with account numbers, you can make a complaint.

    Asking them to 'look into it' means nothing, you must complain.

    if its not mortgage PPI, then work benefits are a strong complaint reason. If it is mortgage PPI then its not.

    It's not mortgage PPI, just personal loan PPI. Hopefully in that case then I have a case.

    As I say, my wife's case was upheld on the same grounds with the same employer, so I don't know how Halifax would be able to refuse it.

    Do you have paperwork for the PPI on the 2 loans? due to the year you may have trouble with these.

    Banks won on the Overdraft charges in 09, you can still put a complaint in though if you are in financial hardship, that is not to say you will win but you can try.

    Husband took out an Egg Credit Card online in 2003. It had CRP which Canada Square have confirmed. They have rejected missale claim (full sick/redundancy/death package as works for police) and given the following reasons:

    1. Did not require as condition of CC
    2. Did not provide advisory service
    3. Required you to positively confirm you wished to purchase policy during application
    4. Provided full t&c and requested read before submitting

    The card was taken out a long time ago but do not believe he would have opted for CRP. Would they be able to provide evidence of this for us or is this now not worth following up??

    Any advice would be gratefully received! Thanks :(

    Technically, their responses are accurate. It wasnt compulsory. They didn't provide advice and it was a tick box to have it. It is hard for them to prove point 4 but they dont have to as it is assumed that is the case unless you can prove otherwise.

    They seem to have disregarded the employment benefits. Did you state that as a complaint reason? If so, then refer it to the FOS if the case was sold to you. If it was bought online or via mailshot then you are going to need a good dose of luck as it was not sold in that case but bought.

    Take to FOS My Husband had the same, and FOS advised Barclays to up hold on the grounds that they didn't supply enough information to make a correct decision on whether the PPI would be a benefit or not at the time of sale. But saying this Barclays still havent agreed after nearly 2 months so they still will probably reject it :(
